88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter E, Chapter 51, Education Code, is
1010 amended by adding Section 51.2031 to read as follows:
1111 Sec. 51.2031. FIREARMS POLICY. (a) In this section,
1212 "institution of higher education" has the meaning assigned by
1313 Section 61.003.
1414 (b) Each institution of higher education shall adopt a
1515 policy regarding the use of firearms by a campus peace officer
1616 commissioned by the institution under Section 51.203. The policy
1717 must prohibit a campus peace officer from drawing a firearm in an
1818 interaction with a member of the public unless the officer
1919 physically sees that another weapon, other than a weapon carried by
2020 a peace officer, is present during the interaction.
2121 SECTION 2. As soon as practicable after the effective date
2222 of this Act, each public institution of higher education shall
2323 adopt the firearms policy required under Section 51.2031, Education
2424 Code, as added by this Act.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2023.
