| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.1058, Education Code, is amended by |

| 11 | 11 | | adding Subsection (d) to read as follows: |

| 12 | 12 | | (d) An open-enrollment charter school and an officer, |
|---|
| 13 | 13 | | employee, or member of the governing body of an open-enrollment |
|---|
| 14 | 14 | | charter school are subject to Section 660.093, Government Code, as |
|---|
| 15 | 15 | | though the school were a state agency and the officer, employee, or |
|---|
| 16 | 16 | | member were a state employee, regardless of whether state funds are |
|---|
| 17 | 17 | | used to pay or reimburse for the travel of the officer, employee, or |
|---|
| 18 | 18 | | member. |

| 19 | 19 | | SECTION 2. This Act takes effect September 1, 2023. |
