8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 364.011(a), Health and Safety Code, is |
---|
10 | 10 | | amended to read as follows: |

11 | 11 | | (a) Subject to [the limitation provided by] Sections |
---|
12 | 12 | | 361.151 and 361.152 [(Solid Waste Disposal Act),] and [subject] to |
---|
13 | 13 | | Subsection (a-1): |
---|
14 | 14 | | (1) [,] a commissioners court of a county with a |
---|
15 | 15 | | population of 500,000 or less by rule may regulate solid waste |
---|
16 | 16 | | collection, handling, storage, and disposal in areas of the county |
---|
17 | 17 | | not in a municipality or the extraterritorial jurisdiction of a |
---|
18 | 18 | | municipality; and |
---|
19 | 19 | | (2) a commissioners court of a county with a |
---|
20 | 20 | | population of more than 500,000 shall regulate solid waste |
---|
21 | 21 | | collection, handling, storage, and disposal in areas of the county |
---|
22 | 22 | | not in a municipality or the extraterritorial jurisdiction of a |
---|
23 | 23 | | municipality. |

24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
