55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain laws on the provision of
88 money to organizations that support access to health care services
99 and the repeal of certain laws prohibiting abortion.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 161, Health and Safety Code, is amended
1212 by adding Subchapter Y to read as follows:
1313 SUBCHAPTER Y. APPLICABILITY OF LAWS PROHIBITING HEALTH CARE
1414 SERVICES
1515 Sec. 161.751. APPLICABILITY OF LAWS ON PROVISION OF MONEY
1616 TO CERTAIN ORGANIZATIONS. The provision of money, including a
1717 donation or gift, to an organization that provides support services
1818 to an individual in accessing a health care service:
1919 (1) does not constitute a violation of any prohibition
2020 under state law on the provision of that health care service; and
2121 (2) may not be the basis for a cause of action related
2222 to the provision of that health care service.
2323 SECTION 2. Section 19.06, Penal Code, is amended to read as
2424 follows:
2525 Sec. 19.06. APPLICABILITY TO CERTAIN CONDUCT. This chapter
2626 does not apply to the death of an unborn child if the conduct
2727 charged is:
2828 (1) conduct committed by the mother of the unborn
2929 child;
3030 (2) a lawful medical procedure performed by a
3131 physician or other licensed health care provider with the requisite
3232 consent, if the death of the unborn child was the intended result of
3333 the procedure;
3434 (3) a lawful medical procedure performed by a
3535 physician or other licensed health care provider with the requisite
3636 consent as part of an assisted reproduction as defined by Section
3737 160.102, Family Code; [or]
3838 (4) the dispensation of a drug in accordance with law
3939 or administration of a drug prescribed in accordance with law; or
4040 (5) the provision of money to an organization that
4141 provides support services to an individual in accessing health care
4242 services.
4343 SECTION 3. Section 22.12, Penal Code, is amended to read as
4444 follows:
4545 Sec. 22.12. APPLICABILITY TO CERTAIN CONDUCT. This chapter
4646 does not apply to conduct charged as having been committed against
4747 an individual who is an unborn child if the conduct is:
4848 (1) committed by the mother of the unborn child;
4949 (2) a lawful medical procedure performed by a
5050 physician or other health care provider with the requisite consent;
5151 (3) a lawful medical procedure performed by a
5252 physician or other licensed health care provider with the requisite
5353 consent as part of an assisted reproduction as defined by Section
5454 160.102, Family Code; [or]
5555 (4) the dispensation of a drug in accordance with law
5656 or administration of a drug prescribed in accordance with law; or
5757 (5) the provision of money to an organization that
5858 provides support services to an individual in accessing health care
5959 services.
6060 SECTION 4. Section 171.206(b), Health and Safety Code, is
6161 amended to read as follows:
6262 (b) This subchapter may not be construed to:
6363 (1) authorize the initiation of a cause of action
6464 against or the prosecution of a woman on whom an abortion is
6565 performed or induced or attempted to be performed or induced in
6666 violation of this subchapter;
6767 (2) wholly or partly repeal, either expressly or by
6868 implication, any other statute that regulates or prohibits
6969 abortion[, including Chapter 6-1/2, Title 71, Revised Statutes]; or
7070 (3) restrict a political subdivision from regulating
7171 or prohibiting abortion in a manner that is at least as stringent as
7272 the laws of this state.
7373 SECTION 5. Section 171.207(b), Health and Safety Code, is
7474 amended to read as follows:
7575 (b) Subsection (a) may not be construed to:
7676 (1) legalize the conduct prohibited by this subchapter
7777 [or by Chapter 6-1/2, Title 71, Revised Statutes];
7878 (2) limit in any way or affect the availability of a
7979 remedy established by Section 171.208; or
8080 (3) limit the enforceability of any other laws that
8181 regulate or prohibit abortion.
8282 SECTION 6. Chapter 6-1/2, Title 71, Revised Statutes, is
8383 repealed.
8484 SECTION 7. This Act takes effect September 1, 2023.
