| 7 | 7 | | relating to compensation of school district trustees. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 11.061(d), Education Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (d) The trustees serve without compensation, unless |
|---|
| 12 | 12 | | compensation of a specified amount is approved by the district. The |
|---|
| 13 | 13 | | trustees' compensation may not be paid from state or federal funds. |
|---|
| 14 | 14 | | Notwithstanding this subsection, a person may not receive |
|---|
| 15 | 15 | | compensation for serving as a trustee if the person: |
|---|
| 16 | 16 | | (1) holds an office other than the position of trustee |
|---|
| 17 | 17 | | that is considered a civil office of emolument under Section 40, |
|---|
| 18 | 18 | | Article XVI, Texas Constitution; or |
|---|
| 19 | 19 | | (2) receives compensation for other services directly |
|---|
| 20 | 20 | | or indirectly from the state. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2023. |
