55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to civil and criminal liability for the unlawful
88 disclosure or promotion of intimate visual material.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 98B.002, Civil Practice and Remedies
1111 Code, is amended by amending Subsection (a) and adding Subsection
1212 (c) to read as follows:
1313 (a) A defendant is liable, as provided by this chapter, to a
1414 person depicted in intimate visual material for damages arising
1515 from the disclosure of the material if:
1616 (1) the defendant discloses the intimate visual
1717 material without the effective consent of the depicted person and
1818 with the intent to harm that person;
1919 (2) either:
2020 (A) at the time of the disclosure, the defendant
2121 knows or has reason to believe that the intimate visual material was
2222 obtained by the defendant or created under circumstances in which
2323 the depicted person had a reasonable expectation that the material
2424 would remain private; or
2525 (B) the intimate visual material was created,
2626 adapted, or modified as described by Subsection (c);
2727 (3) the disclosure of the intimate visual material
2828 causes harm to the depicted person; and
2929 (4) the disclosure of the intimate visual material
3030 reveals the identity of the depicted person in any manner,
3131 including through:
3232 (A) any accompanying or subsequent information
3333 or material related to the intimate visual material; or
3434 (B) information or material provided by a third
3535 party in response to the disclosure of the intimate visual
3636 material.
3737 (c) For purposes of conduct for which a defendant is liable
3838 under Subsection (a) or (b), intimate visual material to which that
3939 conduct applies includes a depiction of a person:
4040 (1) who is recognizable as an actual person by the
4141 person's face, likeness, or other distinguishing characteristic,
4242 such as a unique birthmark or other recognizable feature; and
4343 (2) whose image was used in creating, adapting, or
4444 modifying the intimate visual material, including
4545 computer-generated intimate visual material that was created,
4646 adapted, or modified using an artificial intelligence application
4747 or other computer software.
4848 SECTION 2. Section 21.16, Penal Code, is amended by
4949 amending Subsection (b) and adding Subsection (d-1) to read as
5050 follows:
5151 (b) A person commits an offense if:
5252 (1) without the effective consent of the depicted
5353 person and with the intent to harm that person, the person discloses
5454 visual material depicting another person with the person's intimate
5555 parts exposed or engaged in sexual conduct;
5656 (2) either:
5757 (A) at the time of the disclosure, the person
5858 knows or has reason to believe that the visual material was obtained
5959 by the person or created under circumstances in which the depicted
6060 person had a reasonable expectation that the visual material would
6161 remain private; or
6262 (B) the visual material was created, adapted, or
6363 modified as described by Subsection (d-1);
6464 (3) the disclosure of the visual material causes harm
6565 to the depicted person; and
6666 (4) the disclosure of the visual material reveals the
6767 identity of the depicted person in any manner, including through:
6868 (A) any accompanying or subsequent information
6969 or material related to the visual material; or
7070 (B) information or material provided by a third
7171 party in response to the disclosure of the visual material.
7272 (d-1) For purposes of conduct prohibited under Subsection
7373 (b), (c), or (d), visual material to which that conduct applies
7474 includes a depiction of a person:
7575 (1) who is recognizable as an actual person by the
7676 person's face, likeness, or other distinguishing characteristic,
7777 such as a unique birthmark or other recognizable feature; and
7878 (2) whose image was used in creating, adapting, or
7979 modifying the visual material, including computer-generated visual
8080 material that was created, adapted, or modified using an artificial
8181 intelligence application or other computer software.
8282 SECTION 3. (a) Section 98B.002, Civil Practice and
8383 Remedies Code, as amended by this Act, applies only to a cause of
8484 action that accrues on or after the effective date of this Act. A
8585 cause of action that accrues before the effective date of this Act
8686 is governed by the law applicable to the cause of action immediately
8787 before the effective date of this Act, and that law is continued in
8888 effect for that purpose.
8989 (b) Section 21.16, Penal Code, as amended by this Act,
9090 applies only to an offense committed on or after the effective date
9191 of this Act. An offense committed before the effective date of this
9292 Act is governed by the law in effect on the date the offense was
9393 committed, and the former law is continued in effect for that
9494 purpose. For purposes of this subsection, an offense was committed
9595 before the effective date of this Act if any element of the offense
9696 was committed before that date.
9797 SECTION 4. This Act takes effect September 1, 2023.
