77 AN ACT
88 relating to publication by the attorney general of a contingent fee
99 contract for legal services for political subdivisions and related
1010 information.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2254.1038(b), Government Code, is
1313 amended to read as follows:
1414 (b) Within 90 days after receiving a contract from a
1515 political subdivision, the attorney general:
1616 (1) shall publish the contract and the information
1717 filed under Subsection (a) related to the contract on the attorney
1818 general's Internet website; and
1919 (2) may:
2020 (A) [(1)] approve the contract;
2121 (B) [(2)] refuse to approve the contract because
2222 the requirements of this subchapter were not fulfilled; or
2323 (C) [(3)] refuse to approve the contract
2424 because:
2525 (i) [(A)] the legal matter that is the
2626 subject of the contract presents one or more questions of law or
2727 fact that are in common with a matter the state has already
2828 addressed or is pursuing; and
2929 (ii) [(B)] pursuit of the matter by the
3030 political subdivision will not promote the just and efficient
3131 resolution of the matter.
3232 SECTION 2. Section 2254.1038(b), Government Code, as
3333 amended by this Act, applies only to a contract filed on or after
3434 the effective date of this Act. A contract filed before the
3535 effective date of this Act is governed by the law as it existed
3636 immediately before the effective date of this Act, and that law is
3737 continued in effect for that purpose.
3838 SECTION 3. This Act takes effect September 1, 2023.
