| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 2254.1038(b), Government Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b) Within 90 days after receiving a contract from a |
|---|
| 15 | 15 | | political subdivision, the attorney general: |
|---|
| 16 | 16 | | (1) shall publish the contract and the information |
|---|
| 17 | 17 | | filed under Subsection (a) related to the contract on the attorney |
|---|
| 18 | 18 | | general's Internet website; and |
|---|
| 19 | 19 | | (2) may: |
|---|
| 20 | 20 | | (A) [(1)] approve the contract; |
|---|
| 21 | 21 | | (B) [(2)] refuse to approve the contract because |
|---|
| 22 | 22 | | the requirements of this subchapter were not fulfilled; or |
|---|
| 23 | 23 | | (C) [(3)] refuse to approve the contract |
|---|
| 24 | 24 | | because: |
|---|
| 25 | 25 | | (i) [(A)] the legal matter that is the |
|---|
| 26 | 26 | | subject of the contract presents one or more questions of law or |
|---|
| 27 | 27 | | fact that are in common with a matter the state has already |
|---|
| 28 | 28 | | addressed or is pursuing; and |
|---|
| 29 | 29 | | (ii) [(B)] pursuit of the matter by the |
|---|
| 30 | 30 | | political subdivision will not promote the just and efficient |
|---|
| 31 | 31 | | resolution of the matter. |
|---|
| 32 | 32 | | SECTION 2. Section 2254.1038(b), Government Code, as |
|---|
| 33 | 33 | | amended by this Act, applies only to a contract filed on or after |
|---|
| 34 | 34 | | the effective date of this Act. A contract filed before the |
|---|
| 35 | 35 | | effective date of this Act is governed by the law as it existed |
|---|
| 36 | 36 | | immediately before the effective date of this Act, and that law is |
|---|
| 37 | 37 | | continued in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
