77 relating to the minimum wage.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 62.051, Labor Code, is amended to read as
1010 follows:
1111 Sec. 62.051. MINIMUM WAGE. (a) Except as provided by
1212 Section 62.057, an employer shall pay to each employee not less than
1313 the greater of:
1414 (1) $17 an hour; or
1515 (2) the federal minimum wage under Section 6, Fair
1616 Labor Standards Act of 1938 (29 U.S.C. Section 206).
1717 (b) This subsection applies to wages paid by an employer for
1818 the 2024 calendar year. Subsection (a) does not apply in the 2024
1919 calendar year. Except as provided by Section 62.057, an employer
2020 shall pay to each employee not less than the greater of:
2121 (1) $13.50 an hour; or
2222 (2) the federal minimum wage under Section 6, Fair
2323 Labor Standards Act of 1938 (29 U.S.C. Section 206).
2424 (c) Subsection (b) and this subsection expire January 1,
2525 2025.
2626 SECTION 2. Section 62.052(a), Labor Code, is amended to
2727 read as follows:
2828 (a) In determining the wage of a tipped employee, the amount
2929 paid the employee by the employer may not be less than 50 percent of
3030 [is] the amount required by [described as paid to a tipped employee
3131 under] Section 62.051 [3(m), Fair Labor Standards Act of 1938 (29
3232 U.S.C. Section 203(m))].
3333 SECTION 3. Section 62.151, Labor Code, is repealed.
3434 SECTION 4. This Act takes effect January 1, 2024.
