| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 62.051, Labor Code, is amended to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | Sec. 62.051. MINIMUM WAGE. (a) Except as provided by |
|---|
| 12 | 12 | | Section 62.057, an employer shall pay to each employee not less than |
|---|
| 13 | 13 | | the greater of: |
|---|
| 14 | 14 | | (1) $17 an hour; or |
|---|
| 15 | 15 | | (2) the federal minimum wage under Section 6, Fair |
|---|
| 16 | 16 | | Labor Standards Act of 1938 (29 U.S.C. Section 206). |
|---|
| 17 | 17 | | (b) This subsection applies to wages paid by an employer for |
|---|
| 18 | 18 | | the 2024 calendar year. Subsection (a) does not apply in the 2024 |
|---|
| 19 | 19 | | calendar year. Except as provided by Section 62.057, an employer |
|---|
| 20 | 20 | | shall pay to each employee not less than the greater of: |
|---|
| 21 | 21 | | (1) $13.50 an hour; or |
|---|
| 22 | 22 | | (2) the federal minimum wage under Section 6, Fair |
|---|
| 23 | 23 | | Labor Standards Act of 1938 (29 U.S.C. Section 206). |

| 24 | 24 | | (c) Subsection (b) and this subsection expire January 1, |
|---|
| 25 | 25 | | 2025. |
|---|
| 26 | 26 | | SECTION 2. Section 62.052(a), Labor Code, is amended to |
|---|
| 27 | 27 | | read as follows: |
|---|
| 28 | 28 | | (a) In determining the wage of a tipped employee, the amount |
|---|
| 29 | 29 | | paid the employee by the employer may not be less than 50 percent of |
|---|
| 30 | 30 | | [is] the amount required by [described as paid to a tipped employee |
|---|
| 31 | 31 | | under] Section 62.051 [3(m), Fair Labor Standards Act of 1938 (29 |
|---|
| 32 | 32 | | U.S.C. Section 203(m))]. |
|---|
| 33 | 33 | | SECTION 3. Section 62.151, Labor Code, is repealed. |

| 34 | 34 | | SECTION 4. This Act takes effect January 1, 2024. |
