5	5	relating to periodic reauthorization of municipal building permit

7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subchapter Z, Chapter 214, Local Government
9	9	Code, is amended by adding Section 214.908 to read as follows:
10	10	Sec. 214.908. REAUTHORIZATION OF BUILDING PERMIT FEES. (a)
11	11	In this section, "building permit fee" means a fee charged by a
12	12	municipality as a condition to constructing, renovating, or
13	13	remodeling a structure.
14	14	(b) A building permit fee is abolished on the 10th
15	15	anniversary after the date the fee is adopted or most recently
16	16	reauthorized under this section unless the governing body of the
17	17	municipality that adopted or reauthorized the fee:
18	18	(1) holds a public hearing on the reauthorization of
19	19	the fee; and
20	20	(2) reauthorizes the fee by vote of the governing
21	21	body.
22	22	SECTION 2. This Act takes effect January 1, 2024.
