55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to supplemental pay for members of the Texas military
88 forces suffering an economic hardship as a result of serving on
99 military duty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 437.220(a), (b), and (c), Government
1212 Code, are amended to read as follows:
1313 (a) A person who is called to military duty as a member of
1414 the Texas military forces [National Guard] in the service of this
1515 state or the United States by proper federal or state authority and
1616 who suffers an economic hardship as a result of serving on military
1717 duty is eligible to receive supplemental pay for serving in
1818 accordance with this section. Payment under this subsection is
1919 subject to the availability of funds.
2020 (b) The comptroller shall establish the Texas military
2121 forces [National Guard members'] supplemental military duty pay
2222 account in the general revenue fund. Money in the account may be
2323 appropriated only for purposes of implementing this section. The
2424 comptroller, governor, or adjutant general may accept gifts and
2525 grants for deposit to the credit of the account. The legislature
2626 may transfer money into the account or may appropriate money to
2727 implement this section and the comptroller shall credit that money
2828 to the account.
2929 (c) A member of the Texas military forces [National Guard]
3030 described by Subsection (a) is eligible to receive supplemental pay
3131 under this section in an amount not to exceed the lesser of:
3232 (1) the amount required to alleviate the economic
3333 hardship the member suffers as a result of serving on active duty;
3434 and
3535 (2) the difference between the amount of income that
3636 the member has lost from civilian employment as a result of being
3737 called to military duty and the amount of military pay and
3838 allowances the member receives from state or federal sources while
3939 on military duty.
4040 SECTION 2. The change in law made by this Act applies to
4141 military duty by a member of the Texas military forces occurring on
4242 or after the effective date of this Act regardless of the date the
4343 member was called to military duty. Military duty occurring before
4444 the effective date of this Act is governed by the law in effect on
4545 the date the military duty occurred, and the former law is continued
4646 in effect for that purpose.
4747 SECTION 3. This Act takes effect September 1, 2023.
