| 7 | 7 | | relating to supplemental pay for members of the Texas military |

| 8 | 8 | | forces suffering an economic hardship as a result of serving on |
|---|
| 9 | 9 | | military duty. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 437.220(a), (b), and (c), Government |
|---|
| 12 | 12 | | Code, are amended to read as follows: |
|---|
| 13 | 13 | | (a) A person who is called to military duty as a member of |
|---|
| 14 | 14 | | the Texas military forces [National Guard] in the service of this |
|---|
| 15 | 15 | | state or the United States by proper federal or state authority and |
|---|
| 16 | 16 | | who suffers an economic hardship as a result of serving on military |
|---|
| 17 | 17 | | duty is eligible to receive supplemental pay for serving in |
|---|
| 18 | 18 | | accordance with this section. Payment under this subsection is |
|---|
| 19 | 19 | | subject to the availability of funds. |
|---|
| 20 | 20 | | (b) The comptroller shall establish the Texas military |
|---|
| 21 | 21 | | forces [National Guard members'] supplemental military duty pay |
|---|
| 22 | 22 | | account in the general revenue fund. Money in the account may be |
|---|
| 23 | 23 | | appropriated only for purposes of implementing this section. The |
|---|
| 24 | 24 | | comptroller, governor, or adjutant general may accept gifts and |
|---|
| 25 | 25 | | grants for deposit to the credit of the account. The legislature |
|---|
| 26 | 26 | | may transfer money into the account or may appropriate money to |
|---|
| 27 | 27 | | implement this section and the comptroller shall credit that money |
|---|
| 28 | 28 | | to the account. |
|---|
| 29 | 29 | | (c) A member of the Texas military forces [National Guard] |
|---|
| 30 | 30 | | described by Subsection (a) is eligible to receive supplemental pay |
|---|
| 31 | 31 | | under this section in an amount not to exceed the lesser of: |
|---|
| 32 | 32 | | (1) the amount required to alleviate the economic |
|---|
| 33 | 33 | | hardship the member suffers as a result of serving on active duty; |
|---|
| 34 | 34 | | and |
|---|
| 35 | 35 | | (2) the difference between the amount of income that |
|---|
| 36 | 36 | | the member has lost from civilian employment as a result of being |
|---|
| 37 | 37 | | called to military duty and the amount of military pay and |
|---|
| 38 | 38 | | allowances the member receives from state or federal sources while |
|---|
| 39 | 39 | | on military duty. |
|---|
| 40 | 40 | | SECTION 2. The change in law made by this Act applies to |
|---|
| 41 | 41 | | military duty by a member of the Texas military forces occurring on |
|---|
| 42 | 42 | | or after the effective date of this Act regardless of the date the |
|---|
| 43 | 43 | | member was called to military duty. Military duty occurring before |
|---|
| 44 | 44 | | the effective date of this Act is governed by the law in effect on |
|---|
| 45 | 45 | | the date the military duty occurred, and the former law is continued |
|---|
| 46 | 46 | | in effect for that purpose. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2023. |
