66 AN ACT
77 relating to the administration of anesthesia by a certified
88 registered nurse anesthetist on the order of a dentist.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 258.001, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 258.001. IMPERMISSIBLE DELEGATIONS. A dentist may not
1313 delegate:
1414 (1) an act to an individual who, by board order, is
1515 prohibited from performing the act;
1616 (2) any of the following acts to a person not licensed
1717 as a dentist or dental hygienist:
1818 (A) the removal of calculus, deposits, or
1919 accretions from the natural and restored surfaces of exposed human
2020 teeth and restorations in the human mouth;
2121 (B) root planing or the smoothing and polishing
2222 of roughened root surfaces or exposed human teeth; or
2323 (C) any other act the delegation of which is
2424 prohibited by board rule;
2525 (3) any of the following acts to a person not licensed
2626 as a dentist:
2727 (A) comprehensive examination or diagnosis and
2828 treatment planning;
2929 (B) a surgical or cutting procedure on hard or
3030 soft tissue;
3131 (C) the prescription of a drug, medication, or
3232 work authorization;
3333 (D) the taking of an impression for a final
3434 restoration, appliance, or prosthesis;
3535 (E) the making of an intraoral occlusal
3636 adjustment;
3737 (F) direct pulp capping, pulpotomy, or any other
3838 endodontic procedure;
3939 (G) the final placement and intraoral adjustment
4040 of a fixed or removable appliance; or
4141 (H) the placement of any final restoration; or
4242 (4) the authority to an individual to administer a
4343 local anesthetic agent, inhalation sedative agent, parenteral
4444 sedative agent, or general anesthetic agent, including as a
4545 teledentistry dental service as that term is defined by Section
4646 111.001, if the individual is not licensed as:
4747 (A) a dentist with a permit issued by the board
4848 for the procedure being performed, if a permit is required;
4949 (B) a certified registered nurse anesthetist
5050 licensed by the Texas Board of Nursing[, only if the delegating
5151 dentist holds a permit issued by the board for the procedure being
5252 performed, if a permit is required]; or
5353 (C) a physician anesthesiologist licensed by the
5454 Texas Medical Board.
5555 SECTION 2. Subchapter D, Chapter 258, Occupations Code, is
5656 amended by adding Section 258.158 to read as follows:
5757 Sec. 258.158. ADMINISTRATION OF ANESTHESIA BY NURSE
5858 ANESTHETIST. (a) The board and the Texas Board of Nursing shall
5959 jointly adopt rules governing the administration of anesthesia by a
6060 certified registered nurse anesthetist on the order of a dentist.
6161 The rules must:
6262 (1) for each category under Section 258.155(a),
6363 establish standards and requirements for the administration of
6464 anesthesia by a certified registered nurse anesthetist on the order
6565 of a dentist who does not hold a permit in that category; and
6666 (2) authorize a dentist to order, and a certified
6767 registered nurse anesthetist to administer, anesthesia in
6868 accordance with the standards and requirements described by
6969 Subdivision (1).
7070 (b) Rules adopted under Subsection (a) do not apply to the
7171 administration of anesthesia:
7272 (1) in a licensed hospital or licensed ambulatory
7373 surgical center; or
7474 (2) by a certified registered nurse anesthetist acting
7575 under the delegated authority of a dentist who holds a permit to
7676 administer the anesthesia.
7777 SECTION 3. Not later than January 1, 2024, the State Board
7878 of Dental Examiners and the Texas Board of Nursing shall jointly
7979 adopt rules under Section 258.158, Occupations Code, as added by
8080 this Act.
8181 SECTION 4. This Act takes effect September 1, 2023.
