66 relating to the protection of students from sexual grooming.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Add a new Subchapter H, Chapter 38, Education
99 Code, to read as follows:
1010 SUBCHAPTER H. SEXUAL GROOMING PROTECTION ACT
1111 Sec. 38.401. SEXUAL GROOMING PROTECTION. (a)
1212 Notwithstanding any other provision of this code, as provided by
1313 this subchapter a parent who determines that their child is
1414 subjected to sexual grooming at a public school is entitled to the
1515 right to protect their child from such sexual grooming by selecting
1616 another school, public or private, for their child in which event
1717 Chapter 48 funding for the education of that child shall flow with
1818 the child to the new school selected by the parents.
1919 Sec. 38.402. DEFINITION. Sexual Grooming is defined as any
2020 effort to desensitize children to sexual experiences, or to
2121 normalize sexual relationships with adults or children of the same
2222 or opposite sex.
2323 Sec. 38.403. ACCREDITED PRIVATE SCHOOL PARTICIPATION (a)
2424 The commissioner shall adopt rules to implement the program. Rules
2525 shall be designed to prohibit fraud and abuse. The rules may not in
2626 any form effect or attempt to control the programs, curricula, or
2727 other operations of private schools who participate in the program
2828 other than rules for accredited private schools which were in
2929 effect January 1, 2023.
3030 (b) No federal funds or Available School Funds shall be used
3131 to fund programs under this subsection.
3232 SECTION 2. This Act takes effect September 1, 2023.
