66 AN ACT
77 relating to the purchase and use of and access to information on
88 contraceptives.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 161, Health and Safety Code, is amended
1111 by adding Subchapter Y to read as follows:
1212 SUBCHAPTER Y. CONTRACEPTIVES
1313 Sec. 161.751. DEFINITIONS. In this subchapter:
1414 (1) "Contraceptive" means a drug, device, or other
1515 method of preventing pregnancy that is approved by the United
1616 States Food and Drug Administration.
1717 (2) "Emergency contraceptive" means a drug containing
1818 an elevated dose of hormones that:
1919 (A) is used postcoitally;
2020 (B) prevents pregnancy by preventing
2121 fertilization of an egg or preventing implantation of a fertilized
2222 egg in a uterus; and
2323 (C) is approved by the United States Food and
2424 Drug Administration.
2525 Sec. 161.752. PROHIBITED GOVERNMENTAL RESTRICTIONS RELATED
2626 TO CONTRACEPTIVES. Notwithstanding any other law, a state or local
2727 governmental entity may not prohibit or restrict in any manner the
2828 right of an individual:
2929 (1) to purchase or use a contraceptive, including an
3030 emergency contraceptive; or
3131 (2) to access information on contraceptives,
3232 including emergency contraceptives.
3333 SECTION 2. This Act takes effect September 1, 2023.
