| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 161, Health and Safety Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter Y to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER Y. CONTRACEPTIVES |
|---|
| 13 | 13 | | Sec. 161.751. DEFINITIONS. In this subchapter: |
|---|
| 14 | 14 | | (1) "Contraceptive" means a drug, device, or other |
|---|
| 15 | 15 | | method of preventing pregnancy that is approved by the United |
|---|
| 16 | 16 | | States Food and Drug Administration. |
|---|
| 17 | 17 | | (2) "Emergency contraceptive" means a drug containing |
|---|
| 18 | 18 | | an elevated dose of hormones that: |
|---|
| 19 | 19 | | (A) is used postcoitally; |
|---|
| 20 | 20 | | (B) prevents pregnancy by preventing |
|---|
| 21 | 21 | | fertilization of an egg or preventing implantation of a fertilized |
|---|
| 22 | 22 | | egg in a uterus; and |
|---|
| 23 | 23 | | (C) is approved by the United States Food and |
|---|
| 24 | 24 | | Drug Administration. |
|---|
| 25 | 25 | | Sec. 161.752. PROHIBITED GOVERNMENTAL RESTRICTIONS RELATED |
|---|
| 26 | 26 | | TO CONTRACEPTIVES. Notwithstanding any other law, a state or local |
|---|
| 27 | 27 | | governmental entity may not prohibit or restrict in any manner the |
|---|
| 28 | 28 | | right of an individual: |
|---|
| 29 | 29 | | (1) to purchase or use a contraceptive, including an |
|---|
| 30 | 30 | | emergency contraceptive; or |
|---|
| 31 | 31 | | (2) to access information on contraceptives, |
|---|
| 32 | 32 | | including emergency contraceptives. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
