9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 61.014, Election Code, is amended by |
---|
11 | 11 | | amending Subsections (a) and (b) and adding Subsection (e) to read |
---|
12 | 12 | | as follows: |
---|
13 | 13 | | (a) Except as otherwise provided by this section, a [A] |
---|
14 | 14 | | person may not use a wireless communication device within 100 feet |
---|
15 | 15 | | of a voting station. |
---|
16 | 16 | | (b) A person may not use any mechanical or electronic means |
---|
17 | 17 | | to record [of recording] images or sound within 100 feet of a voting |
---|
18 | 18 | | station. |
---|
19 | 19 | | (e) A person who is occupying a voting station may use the |
---|
20 | 20 | | person's wireless communication device to access ballot or |
---|
21 | 21 | | candidate information that was downloaded or created before the |
---|
22 | 22 | | person entered the polling place. |

23 | 23 | | SECTION 2. The heading to Section 62.0111, Election Code, |
---|
24 | 24 | | is amended to read as follows: |

25 | 25 | | Sec. 62.0111. NOTICE OF USE [PROHIBITION] OF CERTAIN |

26 | 26 | | DEVICES. |
---|
27 | 27 | | SECTION 3. Section 62.0111(a), Election Code, is amended to |

28 | 28 | | read as follows: |

29 | 29 | | (a) At the discretion of the presiding judge, notice of the |
---|
30 | 30 | | limited [prohibition of the] use of certain devices under Section |
---|
31 | 31 | | 61.014 may be posted at one or more locations in the polling place |
---|
32 | 32 | | where it can be read by persons waiting to vote. |
---|
33 | 33 | | SECTION 4. This Act takes effect immediately if it receives |
---|
34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
---|
35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
---|
37 | 37 | | Act takes effect September 1, 2023. |
