66 AN ACT
77 relating to the categorization, collection, and publication of
88 demographic and other information pertaining to certain public
99 benefits programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Sections 531.0316 and 531.03161 to read as
1313 follows:
1414 Sec. 531.0316. COLLECTION OF DEMOGRAPHIC DATA. (a)
1515 Notwithstanding any other law, if the commission or a health and
1616 human services agency collects the demographic data of individuals
1717 who receive benefits under a health benefits program administered
1818 by the commission or agency, as applicable, the commission or
1919 agency, as applicable, shall, when collecting data relating to:
2020 (1) the race or ethnic origin of an individual,
2121 provide the individual the option to select or identify appropriate
2222 categories and subcategories of race and ethnic origin, including:
2323 (A) the category of Hispanic or Latino with the
2424 option to select or identify the following subcategories:
2525 (i) Argentinian;
2626 (ii) Colombian;
2727 (iii) Cuban;
2828 (iv) Dominican (Dominican Republic);
2929 (v) Ecuadoran;
3030 (vi) Guatemalan;
3131 (vii) Honduran;
3232 (viii) Mexican;
3333 (ix) Nicaraguan;
3434 (x) Panamanian;
3535 (xi) Peruvian;
3636 (xii) Puerto Rican;
3737 (xiii) Salvadoran;
3838 (xiv) Spaniard;
3939 (xv) Venezuelan; and
4040 (xvi) another subcategory written in by the
4141 individual;
4242 (B) the category of African American with the
4343 option to select or identify the following subcategories:
4444 (i) Black American (born in the United
4545 States with African ancestry);
4646 (ii) Afro-Caribbean;
4747 (iii) Nigerian;
4848 (iv) Ethiopian;
4949 (v) Kenyan;
5050 (vi) South African;
5151 (vii) Ghanaian; and
5252 (viii) another subcategory written in by
5353 the individual;
5454 (C) the category of Native American with the
5555 option to select or identify the following subcategories:
5656 (i) Apache;
5757 (ii) Cherokee;
5858 (iii) Chickasaw;
5959 (iv) Choctaw;
6060 (v) Mexican American Indian;
6161 (vi) Navajo; and
6262 (vii) another subcategory written in by the
6363 individual;
6464 (D) the category of Pacific Islander with the
6565 option to select or identify the following subcategories:
6666 (i) Chamorro;
6767 (ii) Guamanian;
6868 (iii) Marshallese;
6969 (iv) Native Hawaiian;
7070 (v) Samoan;
7171 (vi) Tongan; and
7272 (vii) another subcategory written in by the
7373 individual;
7474 (E) the category of Asian with the option to
7575 select or identify the following subcategories:
7676 (i) Indian;
7777 (ii) Bangladeshi;
7878 (iii) Burmese;
7979 (iv) Cambodian;
8080 (v) Chinese (except Taiwanese);
8181 (vi) Filipino;
8282 (vii) Iranian;
8383 (viii) Japanese;
8484 (ix) Korean;
8585 (x) Laotian;
8686 (xi) Nepalese;
8787 (xii) Pakistani;
8888 (xiii) Taiwanese;
8989 (xiv) Thai;
9090 (xv) Vietnamese; and
9191 (xvi) another subcategory written in by the
9292 individual; and
9393 (F) the category of Middle Eastern and North
9494 African with the option to select or identify the following
9595 subcategories:
9696 (i) Egyptian;
9797 (ii) Iraqi;
9898 (iii) Jordanian;
9999 (iv) Lebanese;
100100 (v) Palestinian;
101101 (vi) Syrian; and
102102 (vii) another subcategory written in by the
103103 individual;
104104 (2) the sex or gender of an individual, ask the
105105 following questions:
106106 (A) "What is your gender identity?" and, in
107107 response to the question, provide the individual the option to
108108 select or identify as:
109109 (i) genderqueer;
110110 (ii) man;
111111 (iii) nonbinary;
112112 (iv) transgender man;
113113 (v) transgender woman;
114114 (vi) woman; and
115115 (vii) another sex or gender written in by
116116 the individual;
117117 (B) "What sex were you assigned on your original
118118 birth certificate or other legal document confirming birth?" and,
119119 in response to the question, provide the individual the option to
120120 select:
121121 (i) female;
122122 (ii) male;
123123 (iii) "I was not assigned a sex at birth";
124124 or
125125 (iv) "I was not issued a birth certificate
126126 or other legal document confirming my birth";
127127 (C) "Do you identify as intersex?" and, in
128128 response to the question, provide the individual the option to
129129 select:
130130 (i) no; or
131131 (ii) yes; and
132132 (D) "What does intersex mean to you?" and, in
133133 response to the question, provide the individual the option to
134134 enter the individual's answer; and
135135 (3) more than one demographic category, include the
136136 sexual orientation of an individual as a category and provide the
137137 individual with the option to select or identify as:
138138 (A) asexual;
139139 (B) bisexual;
140140 (C) gay;
141141 (D) heterosexual;
142142 (E) lesbian;
143143 (F) pansexual;
144144 (G) queer;
145145 (H) questioning;
146146 (I) same-gender loving; and
147147 (J) another sexual orientation written in by the
148148 individual.
149149 (b) The commission shall ensure that each local entity,
150150 including a local governmental entity, responsible for providing
151151 demographic data to the commission or a health and human services
152152 agency in connection with a public benefits program administered by
153153 the commission or agency, as applicable, provides the data in the
154154 manner prescribed by this section.
155155 (c) In collecting demographic data, the commission and each
156156 health and human services agency shall provide individuals from
157157 whom the data is sought the option to select more than one category
158158 for race or ethnic origin and more than one subcategory for race or
159159 ethnic origin.
160160 (d) The provision of demographic data under this section by
161161 an individual is voluntary.
162162 (e) Not later than the first anniversary of the date the
163163 federal decennial census is published, the commission shall update
164164 the subcategories of race or ethnic origin to include only the
165165 subcategories with populations larger than 7,500 as published by
166166 the United States Census Bureau, except that each category must
167167 include at least the six largest subcategories.
168168 (f) The executive commissioner shall adopt rules necessary
169169 to implement this section.
170170 Sec. 531.03161. COLLECTION AND CROSS-TABULATION ANALYSIS
171171 OF CERTAIN DATA; PUBLICATION. (a) The commission and each health
172172 and human services agency that administers a public benefits
173173 program shall collect the following data regarding individuals who
174174 receive, or were receiving at the time of the individual's death,
175175 benefits under a program:
176176 (1) the individual's level of English proficiency; and
177177 (2) whether the individual:
178178 (A) has a disability;
179179 (B) has health benefits coverage;
180180 (C) has been diagnosed with a chronic condition,
181181 including cancer, obesity, diabetes, or asthma;
182182 (D) has access to health care, including
183183 preventive care services;
184184 (E) has a diagnosed mental health disorder;
185185 (F) is or has been pregnant;
186186 (G) died as a result of a pregnancy-related
187187 cause; and
188188 (H) had a child who died as an infant.
189189 (b) To the extent permitted by federal law and if requested
190190 by the commission, a local entity, including a local governmental
191191 entity, responsible for providing demographic data to the
192192 commission or a health and human services agency in connection with
193193 a public benefits program administered by the commission or agency,
194194 as applicable, shall report to the commission the data described by
195195 Subsection (a) to the extent that data is known or obtainable by the
196196 entity.
197197 (c) The commission shall prepare a cross-tabulation
198198 analysis of the data described by Subsection (a) and the
199199 demographic data collected under Section 531.0316, including data
200200 related to the race or ethnic origin, sex or gender, and sexual
201201 orientation of individuals. The analysis conducted under this
202202 subsection must consider subcategories and suboptions.
203203 (d) Subject to Subsection (f) and to the extent permitted by
204204 federal law, the commission shall make available to the public on
205205 its Internet website in an easy-to-read format metric data obtained
206206 as the result of the cross-tabulation analysis conducted under this
207207 section and organized by the demographic data collected in
208208 accordance with Section 531.0316. The metric data published under
209209 this section must be organized by category and then by subcategory
210210 or suboption, as applicable.
211211 (e) The commission shall annually update the metric data
212212 published under Subsection (d).
213213 (f) The storage and communication of data under this section
214214 must comply with existing federal and state privacy laws governing
215215 individually identifiable information. Data made available to the
216216 public under this section may not identify or allow for the
217217 identification of individuals.
218218 (g) This section does not prevent a state agency from
219219 posting demographic data collected by the agency on the agency's
220220 Internet website.
221221 (h) The executive commissioner shall adopt rules necessary
222222 to implement this section.
223223 SECTION 2. Not later than December 1, 2024, the Health and
224224 Human Services Commission shall publish on its Internet website the
225225 metric data required under Section 531.03161(d), Government Code,
226226 as added by this Act.
227227 SECTION 3. If before implementing any provision of this Act
228228 a state agency determines that a waiver or authorization from a
229229 federal agency is necessary for implementation of that provision,
230230 the agency affected by the provision shall request the waiver or
231231 authorization and may delay implementing that provision until the
232232 waiver or authorization is granted.
233233 SECTION 4. This Act takes effect September 1, 2023.
