55 relating to the transfer of certain public school students who are
66 children of peace officers.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 25, Education Code, is
99 amended by adding Section 25.0344 to read as follows:
1010 Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF
1111 PEACE OFFICERS. (a) In this section, "peace officer" has the
1212 meaning assigned by Section 1701.001, Occupations Code.
1313 (b) On request of a peace officer who is a parent of or
1414 person standing in parental relation to a student, the board of
1515 trustees of a school district or the board's designee shall
1616 transfer the student to another district campus or to another
1717 school district under an agreement under Section 25.035.
1818 (c) A transfer under this section must be to the campus or
1919 school district, as applicable, selected by the peace officer
2020 making the request.
2121 (d) A school district is not required to provide
2222 transportation to a student who transfers to another campus or
2323 school district under this section.
2424 SECTION 2. This Act applies beginning with the 2023-2024
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2023.
