44 AN ACT
55 relating to the release of a motor vehicle accident report to an
66 employee or authorized representative of a vehicle storage
77 facility.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 550.065(c), Transportation Code, is
1010 amended to read as follows:
1111 (c) On written request and payment of any required fee, the
1212 department or the governmental entity shall release the information
1313 to:
1414 (1) an entity described by Subsection (b);
1515 (2) the law enforcement agency that employs the peace
1616 officer who investigated the accident and sent the information to
1717 the department, including an agent of the law enforcement agency
1818 authorized by contract to obtain the information;
1919 (3) the court in which a case involving a person
2020 involved in the accident is pending if the report is subpoenaed; or
2121 (4) any person directly concerned in the accident or
2222 having a proper interest therein, including:
2323 (A) any person involved in the accident;
2424 (B) the authorized representative of any person
2525 involved in the accident;
2626 (C) a driver involved in the accident;
2727 (D) an employer, parent, or legal guardian of a
2828 driver involved in the accident;
2929 (E) the owner of a vehicle or property damaged in
3030 the accident;
3131 (F) a person who has established financial
3232 responsibility for a vehicle involved in the accident in a manner
3333 described by Section 601.051, including a policyholder of a motor
3434 vehicle liability insurance policy covering the vehicle;
3535 (G) an insurance company that issued an insurance
3636 policy covering a vehicle involved in the accident;
3737 (H) an insurance company that issued a policy
3838 covering any person involved in the accident;
3939 (I) a person under contract to provide claims or
4040 underwriting information to a person described by Paragraph (F),
4141 (G), or (H);
4242 (J) a radio or television station that holds a
4343 license issued by the Federal Communications Commission;
4444 (K) a newspaper that is:
4545 (i) a free newspaper of general circulation
4646 or qualified under Section 2051.044, Government Code, to publish
4747 legal notices;
4848 (ii) published at least once a week; and
4949 (iii) available and of interest to the
5050 general public in connection with the dissemination of news; [or]
5151 (L) any person who may sue because of death
5252 resulting from the accident; or
5353 (M) an employee or authorized representative of a
5454 vehicle storage facility, as defined by Section 2303.002,
5555 Occupations Code, that stored a vehicle involved in the accident.
5656 SECTION 2. This Act takes effect September 1, 2023.
