| 7 | 7 | | relating to the enforcement of commercial motor vehicle safety |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 644.101(c), Transportation Code, as |
|---|
| 11 | 11 | | amended by Chapters 74 (H.B. 2749) and 429 (S.B. 901), Acts of the |
|---|
| 12 | 12 | | 87th Legislature, Regular Session, 2021, is reenacted and amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (c) A sheriff or a deputy sheriff of any of the following |
|---|
| 15 | 15 | | counties is eligible to apply for certification under this section: |
|---|
| 16 | 16 | | (1) a county bordering the United Mexican States; |
|---|
| 17 | 17 | | (2) a county with a population of less than 1,000, part |
|---|
| 18 | 18 | | of which is located within 75 miles of an international border; |
|---|
| 19 | 19 | | (3) a county with a population of 700,000 or more; |
|---|
| 20 | 20 | | (4) a county with a population of 400,000 or more that |
|---|
| 21 | 21 | | borders the county in which the State Capitol is located; [or] |
|---|
| 22 | 22 | | (5) a county with a population of less than 250,000 |
|---|
| 23 | 23 | | that: |
|---|
| 24 | 24 | | (A) is adjacent to two counties that each have a |
|---|
| 25 | 25 | | population of more than 1.2 million; and |
|---|
| 26 | 26 | | (B) contains two highways that are part of the |
|---|
| 27 | 27 | | national system of interstate and defense highways; |
|---|
| 28 | 28 | | (6) [(5)] a county: |
|---|
| 29 | 29 | | (A) any part of which is within 30 miles of New |
|---|
| 30 | 30 | | Mexico; and |
|---|
| 31 | 31 | | (B) that is adjacent to two or more counties that |
|---|
| 32 | 32 | | generated $100 million or more in tax revenue collected under |
|---|
| 33 | 33 | | Chapters 201 and 202, Tax Code, from oil and gas production during |
|---|
| 34 | 34 | | the preceding state fiscal year; [or] |
|---|
| 35 | 35 | | (7) [(6)] a county with a population of more than |
|---|
| 36 | 36 | | 40,000 and less than 300,000 that is adjacent to a county described |
|---|
| 37 | 37 | | by Subdivision (4); or |
|---|
| 38 | 38 | | (8) a county with a population of more than 50,000 and |
|---|
| 39 | 39 | | less than 90,000 that is adjacent to a county with a population of |
|---|
| 40 | 40 | | more than 4,000,000. |
|---|
| 41 | 41 | | SECTION 2. To the extent of any conflict, this Act prevails |
|---|
| 42 | 42 | | over another Act of the 88th Legislature, Regular Session, 2023, |
|---|
| 43 | 43 | | relating to nonsubstantive additions to and corrections in enacted |
|---|
| 44 | 44 | | codes. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2023. |
|---|
