55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the enforcement of commercial motor vehicle safety
88 standards in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 644.101(c), Transportation Code, as
1111 amended by Chapters 74 (H.B. 2749) and 429 (S.B. 901), Acts of the
1212 87th Legislature, Regular Session, 2021, is reenacted and amended
1313 to read as follows:
1414 (c) A sheriff or a deputy sheriff of any of the following
1515 counties is eligible to apply for certification under this section:
1616 (1) a county bordering the United Mexican States;
1717 (2) a county with a population of less than 1,000, part
1818 of which is located within 75 miles of an international border;
1919 (3) a county with a population of 700,000 or more;
2020 (4) a county with a population of 400,000 or more that
2121 borders the county in which the State Capitol is located; [or]
2222 (5) a county with a population of less than 250,000
2323 that:
2424 (A) is adjacent to two counties that each have a
2525 population of more than 1.2 million; and
2626 (B) contains two highways that are part of the
2727 national system of interstate and defense highways;
2828 (6) [(5)] a county:
2929 (A) any part of which is within 30 miles of New
3030 Mexico; and
3131 (B) that is adjacent to two or more counties that
3232 generated $100 million or more in tax revenue collected under
3333 Chapters 201 and 202, Tax Code, from oil and gas production during
3434 the preceding state fiscal year; [or]
3535 (7) [(6)] a county with a population of more than
3636 40,000 and less than 300,000 that is adjacent to a county described
3737 by Subdivision (4); or
3838 (8) a county with a population of more than 50,000 and
3939 less than 90,000 that is adjacent to a county with a population of
4040 more than 4,000,000.
4141 SECTION 2. To the extent of any conflict, this Act prevails
4242 over another Act of the 88th Legislature, Regular Session, 2023,
4343 relating to nonsubstantive additions to and corrections in enacted
4444 codes.
4545 SECTION 3. This Act takes effect September 1, 2023.
