55 AN ACT
66 relating to on-site identification requirements for certain
77 contractors and subcontractors of the Texas Department of
88 Transportation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 201, Transportation Code,
1111 is amended by adding Section 201.625 to read as follows:
1212 Sec. 201.625. ON-SITE IDENTIFICATION REQUIREMENTS FOR
1313 CERTAIN DEPARTMENT CONTRACTORS AND SUBCONTRACTORS. (a) The
1414 commission shall adopt rules establishing identification
1515 requirements for department contractors and subcontractors while
1616 working at the site of a construction, maintenance, or improvement
1717 project of the department.
1818 (b) The rules adopted under Subsection (a) must require:
1919 (1) an employee of the contractor or subcontractor
2020 while working at the site of the project to wear an identification
2121 badge, in the form and manner prescribed by the commission, that
2222 clearly identifies the employee as a department contractor or
2323 subcontractor; and
2424 (2) each vehicle of the contractor or subcontractor
2525 while the vehicle is at the site of the project to display on each
2626 side of the vehicle, in the form and manner prescribed by the
2727 commission, insignia or other markings identifying the vehicle as a
2828 vehicle of a department contractor or subcontractor.
2929 SECTION 2. Not later than December 1, 2023, the Texas
3030 Transportation Commission shall adopt the rules required by Section
3131 201.625, Transportation Code, as added by this Act.
3232 SECTION 3. This Act takes effect September 1, 2023.
