77 relating to the powers of the Harris County Water Control and
88 Improvement District No. 110; providing authority to impose a fee
99 and impose fines and penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 7938 to read as follows:
1313 CHAPTER 7938. HARRIS COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT

1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 7938.0101. DEFINITION. In this chapter, "district"
1717 means the Harris County Water Control and Improvement District
1818 No. 110.
1919 SUBCHAPTER B. POWERS AND DUTIES
2020 Sec. 7938.0201. AUTHORITY TO ISSUE CERTIFICATES OF
2121 COMPLIANCE FOR STORMWATER DETENTION FACILITIES. (a) The district
2222 may implement a program to require and issue an annual written
2323 certificate of compliance to the owner or operator of a stormwater
2424 detention facility within the boundaries of the district to ensure
2525 that each stormwater detention facility is operating to abate
2626 flooding as designed and approved by the applicable regulatory
2727 authority.
2828 (b) The district may assess reasonable charges and fees for
2929 the implementation, administration, and enforcement of this
3030 section.
3131 (c) The district may impose a fine or penalty on the owner or
3232 operator of a stormwater detention facility for the failure to hold
3333 a certificate of compliance as required by the district under this
3434 section.
3535 SECTION 2. The Harris County Water Control and Improvement
3636 District No. 110 retains all the rights, powers, privileges,
3737 authority, duties, and functions that it had before the effective
3838 date of this Act.
3939 SECTION 3. (a) The legislature validates and confirms all
4040 governmental acts and proceedings of the Harris County Water
4141 Control and Improvement District No. 110 that were taken before the
4242 effective date of this Act.
4343 (b) This section does not apply to any matter that on the
4444 effective date of this Act:
4545 (1) is involved in litigation if the litigation
4646 ultimately results in the matter being held invalid by a final court
4747 judgment; or
4848 (2) has been held invalid by a final court judgment.
4949 SECTION 4. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2023.
