| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subtitle F, Title 6, Special District Local Laws |
|---|
| 12 | 12 | | Code, is amended by adding Chapter 7938 to read as follows: |

| 13 | 13 | | CHAPTER 7938. HARRIS COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT |

| 15 | 15 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 16 | 16 | | Sec. 7938.0101. DEFINITION. In this chapter, "district" |
|---|
| 17 | 17 | | means the Harris County Water Control and Improvement District |
|---|
| 18 | 18 | | No. 110. |
|---|
| 19 | 19 | | SUBCHAPTER B. POWERS AND DUTIES |
|---|
| 20 | 20 | | Sec. 7938.0201. AUTHORITY TO ISSUE CERTIFICATES OF |
|---|
| 21 | 21 | | COMPLIANCE FOR STORMWATER DETENTION FACILITIES. (a) The district |
|---|
| 22 | 22 | | may implement a program to require and issue an annual written |
|---|
| 23 | 23 | | certificate of compliance to the owner or operator of a stormwater |
|---|
| 24 | 24 | | detention facility within the boundaries of the district to ensure |
|---|
| 25 | 25 | | that each stormwater detention facility is operating to abate |
|---|
| 26 | 26 | | flooding as designed and approved by the applicable regulatory |
|---|
| 27 | 27 | | authority. |
|---|
| 28 | 28 | | (b) The district may assess reasonable charges and fees for |
|---|
| 29 | 29 | | the implementation, administration, and enforcement of this |
|---|
| 30 | 30 | | section. |
|---|
| 31 | 31 | | (c) The district may impose a fine or penalty on the owner or |
|---|
| 32 | 32 | | operator of a stormwater detention facility for the failure to hold |
|---|
| 33 | 33 | | a certificate of compliance as required by the district under this |
|---|
| 34 | 34 | | section. |
|---|
| 35 | 35 | | SECTION 2. The Harris County Water Control and Improvement |
|---|
| 36 | 36 | | District No. 110 retains all the rights, powers, privileges, |
|---|
| 37 | 37 | | authority, duties, and functions that it had before the effective |
|---|
| 38 | 38 | | date of this Act. |
|---|
| 39 | 39 | | SECTION 3. (a) The legislature validates and confirms all |
|---|
| 40 | 40 | | governmental acts and proceedings of the Harris County Water |
|---|
| 41 | 41 | | Control and Improvement District No. 110 that were taken before the |
|---|
| 42 | 42 | | effective date of this Act. |
|---|
| 43 | 43 | | (b) This section does not apply to any matter that on the |
|---|
| 44 | 44 | | effective date of this Act: |
|---|
| 45 | 45 | | (1) is involved in litigation if the litigation |
|---|
| 46 | 46 | | ultimately results in the matter being held invalid by a final court |
|---|
| 47 | 47 | | judgment; or |
|---|
| 48 | 48 | | (2) has been held invalid by a final court judgment. |
|---|
| 49 | 49 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2023. |
