55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the powers and duties of the Texas Workforce Commission
88 and local workforce development boards regarding the provision of
99 child care.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2308.256(a), Government Code, is amended
1212 to read as follows:
1313 (a) A board is composed as follows:
1414 (1) representatives of the private sector, who:
1515 (A) constitute a majority of the membership of
1616 the board; and
1717 (B) are owners of business concerns, chief
1818 executives or chief operating officers of nongovernmental
1919 employers, or other private sector executives who have substantial
2020 management or policy responsibilities, including owners or
2121 operators of child-care businesses who must constitute not less
2222 than 10 percent of private sector representatives on the board;
2323 (2) representatives of organized labor and
2424 community-based organizations, who constitute not less than 15
2525 percent of the membership of the board; and
2626 (3) representatives of each of the following:
2727 (A) educational agencies, including community
2828 colleges and secondary and postsecondary practitioners
2929 representing vocational education, that are representative of all
3030 educational agencies in the service delivery area;
3131 (B) vocational rehabilitation agencies;
3232 (C) public assistance agencies;
3333 (D) economic development agencies;
3434 (E) the public employment service;
3535 (F) local literacy councils; [and]
3636 (G) adult basic and continuing education
3737 organizations; and
3838 (H) the child-care workforce, including persons
3939 with expertise in child care or early childhood education who are
4040 not included in the representatives described by Subdivision
4141 (1)(B).
4242 SECTION 2. Section 2308.3171, Government Code, is amended
4343 by amending Subsection (c) and adding Subsection (c-1) to read as
4444 follows:
4545 (c) Each board shall post in a prominent place on the
4646 board's Internet website home page and at any physical location
4747 where the board provides services:
4848 (1) a list of local designated vendors that are
4949 child-care providers and have a quality child-care indicator listed
5050 in Subsection (a)(1), (2), (3), or (4); [and]
5151 (2) a list of local parenting classes;
5252 (3) information for parents regarding finding quality
5353 child-care providers;
5454 (4) information regarding the value of quality child
5555 care and the Texas Rising Star Program;
5656 (5) information for parents regarding:
5757 (A) eligibility for child-care assistance,
5858 including subsidized child-care services and other child-care
5959 scholarships;
6060 (B) the application process for child-care
6161 assistance; and
6262 (C) determining the status of a financial
6363 assistance application;
6464 (6) information for child-care providers regarding:
6565 (A) the process for accepting children whose
6666 parents receive child-care assistance; and
6767 (B) the Texas Rising Star Program certification
6868 process; and
6969 (7) contact information, including a telephone number
7070 and an e-mail address, where a child-care provider may receive
7171 assistance with questions or bring a grievance.
7272 (c-1) Each local workforce development board shall make the
7373 following information available to the public on a quarterly basis:
7474 (1) data regarding child-care waitlists, including
7575 the number of children in the board's workforce development area
7676 who are:
7777 (A) on a waitlist, disaggregated by age and zip
7878 code based on the child's home address;
7979 (B) taken off a waitlist and enrolled with a
8080 child-care provider under the subsidized child-care program; and
8181 (C) added to a waitlist during the quarter;
8282 (2) the number of children in the board's workforce
8383 development area receiving subsidized child care, disaggregated by
8484 zip code based on the child's home address;
8585 (3) data regarding child-care providers, including
8686 the number of providers in the board's workforce development area
8787 who during the quarter:
8888 (A) improved the provider's Texas Rising Star
8989 Program rating level;
9090 (B) had the provider's Texas Rising Star Program
9191 rating level decrease; and
9292 (C) received quality dollars from the board; and
9393 (4) data regarding the outcomes related to quality
9494 dollars provided by the board to child-care providers in the
9595 board's workforce development area.
9696 SECTION 3. Subchapter A, Chapter 302, Labor Code, is
9797 amended by adding Section 302.00434 to read as follows:
9898 Sec. 302.00434. SUBSIDIZED CHILD-CARE PROGRAM; RULE CHANGE
9999 POLICY. (a) The commission shall develop appropriate training and
100100 provide the training to local workforce development boards and
101101 persons who contract with a board to provide services related to the
102102 subsidized child-care program.
103103 (b) The commission shall develop a reasonable timeline for
104104 implementing each change the commission makes to:
105105 (1) the rules regarding the subsidized child-care
106106 program; and
107107 (2) the allocation of funds under the subsidized
108108 child-care program.
109109 SECTION 4. Subchapter A, Chapter 302, Labor Code, is
110110 amended by adding Section 302.0063 to read as follows:
111111 Sec. 302.0063. CHILD-CARE PERFORMANCE TARGETS. (a) The
112112 commission shall establish child-care performance targets in a
113113 manner that accounts for cost differentials related to providing
114114 child-care services to various populations. In setting the
115115 performance targets, the commission shall consider:
116116 (1) the total number of children served by child-care
117117 providers in a board's workforce development area;
118118 (2) the number of children served by Texas Rising Star
119119 Program providers in a board's workforce development area with a
120120 two-star, three-star, or four-star rating;
121121 (3) the needs and ages of children served by
122122 child-care providers in a board's workforce development area;
123123 (4) the types of providers commonly selected by
124124 parents in a board's workforce development area; and
125125 (5) any other factors determined necessary by the
126126 commission, including data-driven factors provided to the
127127 commission by a board.
128128 (b) The commission shall, at least once every six months
129129 during the performance period, review the commission's child-care
130130 performance targets and funding based on those targets and make
131131 adjustments based on the cost differentials the commission used at
132132 the time the performance targets were initially set.
133133 SECTION 5. Section 2308.256(g), Government Code, is
134134 repealed.
135135 SECTION 6. This Act takes effect September 1, 2023.
