55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to teacher literacy achievement academies and the
88 requirement for certain public school teachers and principals to
99 attend a teacher literacy achievement academy.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 21.4552, Education Code, is amended by
1212 adding Subsection (d-1) to read as follows:
1313 (d-1) The commissioner is required to implement a provision
1414 of this section only if the legislature appropriates money
1515 specifically for that purpose. If the legislature does not
1616 appropriate money specifically for that purpose, the commissioner
1717 may, but is not required to, implement a provision of this section
1818 using other appropriations available for that purpose.
1919 SECTION 2. Section 28.006(g-1), Education Code, is amended
2020 to read as follows:
2121 (g-1) A school district shall provide additional reading
2222 instruction and intervention to each student in seventh grade
2323 assessed under Subsection (c-1), as appropriate to improve the
2424 student's reading skills in the relevant areas identified through
2525 the assessment instrument. Training and support for activities
2626 required by this subsection shall be provided by regional education
2727 service centers and any teacher literacy achievement academies made
2828 available [established] under Section 21.4552, and may be provided
2929 by other public and private providers.
3030 SECTION 3. Section 28.0062(a), Education Code, is amended
3131 to read as follows:
3232 (a) Each school district and open-enrollment charter school
3333 shall:
3434 (1) provide for the use of a phonics curriculum that
3535 uses systematic direct instruction in kindergarten through third
3636 grade to ensure all students obtain necessary early literacy
3737 skills;
3838 (2) if the commissioner has made available teacher
3939 literacy achievement academies under Section 21.4552, ensure that:
4040 (A) [not later than the 2022-2023 school year,]
4141 each classroom teacher in kindergarten or first, second, or third
4242 grade and each principal at a campus with kindergarten or first,
4343 second, or third grade has attended a teacher literacy achievement
4444 academy [developed under Section 21.4552]; and
4545 (B) each classroom teacher and each principal
4646 initially employed in a grade level or at a campus described by
4747 Paragraph (A) [for the 2022-2023 school year or a subsequent school
4848 year] has attended a teacher literacy achievement academy
4949 [developed under Section 21.4552] by the end of the teacher's or
5050 principal's first year of placement in that grade level or campus;
5151 and
5252 (3) certify to the agency that the district or school:
5353 (A) prioritizes placement of highly effective
5454 teachers in kindergarten through second grade; and
5555 (B) has integrated reading instruments used to
5656 diagnose reading development and comprehension to support each
5757 student in prekindergarten through third grade.
5858 SECTION 4. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2023.
