77 relating to municipal regulation of structured sober living homes.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 229, Local Government Code, is amended
1010 by adding Subchapter D to read as follows:
1111 SUBCHAPTER D. STRUCTURED SOBER LIVING HOMES
1212 Sec. 229.151. DEFINITION OF STRUCTURED SOBER LIVING HOME.
1313 (a) In this subchapter, "structured sober living home" means a
1414 program in which a person:
1515 (1) provides alcohol-free or drug-free housing;
1616 (2) promotes independent living and life skills
1717 development; and
1818 (3) provides structured activities for recovery from
1919 substance abuse disorders in a supervised setting to a group of
2020 unrelated individuals who are:
2121 (A) recovering from alcohol or drug addiction;
2222 and
2323 (B) receiving outpatient behavioral health
2424 services for substance abuse or addiction treatment while residing
2525 in the program's home.
2626 (b) The term "structured sober living home" does not include
2727 a person who requires a related family member to receive outpatient
2828 behavioral health services for substance abuse or addiction
2929 treatment as a condition of continuing to reside in the person's
3030 residence.
3131 Sec. 229.152. REGULATION OF STRUCTURED SOBER LIVING HOMES.
3232 (a) A municipality by ordinance may adopt standards for structured
3333 sober living homes that comply with state and federal fair housing
3434 laws and the Americans with Disabilities Act of 1990 (42 U.S.C.
3535 Section 12101 et seq.).
3636 (b) Standards adopted under Subsection (a) may require
3737 structured sober living homes to:
3838 (1) provide written notice to residents and potential
3939 residents that includes:
4040 (A) the name and address of the property in which
4141 the home is operated; and
4242 (B) for the property in which the home is
4343 operated:
4444 (i) the property owner's name, address, and
4545 telephone number; and
4646 (ii) if the property is leased, a copy of
4747 the lease that states that the property is to be used as a
4848 structured sober living home;
4949 (2) supervise residents during all hours of operation;
5050 and
5151 (3) establish and maintain an operation plan to:
5252 (A) facilitate the rehabilitative process,
5353 including discharge planning;
5454 (B) address the maintenance of the property in
5555 which the home is operated; and
5656 (C) comply with municipal noise abatement
5757 requirements.
5858 (c) A municipality may exempt a structured sober living home
5959 from the standards adopted under this section if the home is subject
6060 to adequate oversight by another governmental entity or contractor.
6161 SECTION 2. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2023.
