44 AN ACT
55 relating to the fees assessed by a district clerk for copies of
66 certain court documents.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 51.318, Government Code, is amended by
99 amending Subsection (e) and adding Subsection (f) to read as
1010 follows:
1111 (e) The district clerk may not charge [United States
1212 Immigration and Customs Enforcement or United States Citizenship
1313 and Immigration Services] a fee for a copy of any document on file
1414 or of record in the clerk's office relating to an individual's
1515 criminal history, regardless of whether the document is certified,
1616 to:
1717 (1) United States Immigration and Customs
1818 Enforcement;
1919 (2) United States Citizenship and Immigration
2020 Services; or
2121 (3) a criminal justice agency that requests the
2222 document for a criminal justice purpose, including a request to
2323 determine an individual's eligibility to purchase a firearm.
2424 (f) In this section, "criminal justice agency" and
2525 "criminal justice purpose" have the meanings assigned by Section
2626 411.082.
2727 SECTION 2. The change in law made by this Act applies only
2828 to a fee for a copy of a court document requested on or after the
2929 effective date of this Act. A fee for a copy of a court document
3030 requested before the effective date of this Act is governed by the
3131 law in effect when the copy was requested, and the former law is
3232 continued in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2023.
