| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2.023(a), Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subsections (b) and (c) or Section |
|---|
| 13 | 13 | | 172.059, the candidates in a runoff election are the candidates who |
|---|
| 14 | 14 | | receive the highest and second highest number of votes in the main |
|---|
| 15 | 15 | | election or who tie for the highest number of votes. |
|---|
| 16 | 16 | | SECTION 2. Section 172.059, Election Code, is amended by |
|---|
| 17 | 17 | | amending Subsections (a) and (c) and adding Subsection (d) to read |
|---|
| 18 | 18 | | as follows: |
|---|
| 19 | 19 | | (a) A candidate for nomination may not withdraw from the |
|---|
| 20 | 20 | | runoff primary election after 5 p.m. of the 21st [3rd] day after the |
|---|
| 21 | 21 | | state canvass under Section 172.120. |
|---|
| 22 | 22 | | (c) If a runoff candidate withdraws from the election on or |
|---|
| 23 | 23 | | before 5 p.m. of the 21st day after the state canvass, the candidate |
|---|
| 24 | 24 | | who received the third highest number of votes in the general |
|---|
| 25 | 25 | | primary election is entitled to a place on the runoff ballot. |
|---|
| 26 | 26 | | (d) If a runoff candidate withdraws after 5 p.m. of the 21st |
|---|
| 27 | 27 | | day after the state canvass, the remaining candidate is the nominee |
|---|
| 28 | 28 | | and the runoff election for that office is not held. |
|---|
| 29 | 29 | | SECTION 3. The changes in law made by this Act apply to an |
|---|
| 30 | 30 | | election ordered on or after the effective date of this Act. An |
|---|
| 31 | 31 | | election ordered before the effective date of this Act is governed |
|---|
| 32 | 32 | | by the law in effect when the election was ordered, and the former |
|---|
| 33 | 33 | | law is continued in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect September 1, 2023. |
