55 relating to the eligibility requirements for a license as a massage
66 establishment, massage school, massage therapist, or massage

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 455.152, Occupations Code, is amended to
1010 read as follows:
1111 Sec. 455.152. INELIGIBILITY FOR LICENSE. A person is not
1212 eligible for a license as a massage establishment, massage school,
1313 massage therapist, or massage therapy instructor if the person is
1414 an individual and has been convicted of, entered a plea of nolo
1515 contendere or guilty to, or received deferred adjudication for:
1616 (1) an offense under Chapter 20A, Section 22.011 or
1717 22.021 [Penal Code], or Subchapter A, Chapter 43, Penal Code; [,] or
1818 (2) another sexual offense.
1919 SECTION 2. This Act takes effect September 1, 2023.
