44 AN ACT
55 relating to the statute of limitations for certain burglary
66 offenses.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Article 12.01, Code of Criminal Procedure, is
99 amended to read as follows:
1010 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1111 felony indictments may be presented within these limits, and not
1212 afterward:
1313 (1) no limitation:
1414 (A) murder and manslaughter;
1515 (B) sexual assault under Section 22.011(a)(2),
1616 Penal Code, or aggravated sexual assault under Section
1717 22.021(a)(1)(B), Penal Code;
1818 (C) sexual assault, if:
1919 (i) during the investigation of the offense
2020 biological matter is collected and the matter:
2121 (a) has not yet been subjected to
2222 forensic DNA testing; or
2323 (b) has been subjected to forensic DNA
2424 testing and the testing results show that the matter does not match
2525 the victim or any other person whose identity is readily
2626 ascertained; or
2727 (ii) probable cause exists to believe that
2828 the defendant has committed the same or a similar sex offense
2929 against five or more victims;
3030 (D) continuous sexual abuse of young child or
3131 disabled individual under Section 21.02, Penal Code;
3232 (E) indecency with a child under Section 21.11,
3333 Penal Code;
3434 (F) an offense involving leaving the scene of an
3535 accident under Section 550.021, Transportation Code, if the
3636 accident resulted in the death of a person;
3737 (G) trafficking of persons under Section
3838 20A.02(a)(7) or (8), Penal Code;
3939 (H) continuous trafficking of persons under
4040 Section 20A.03, Penal Code; [or]
4141 (I) compelling prostitution under Section
4242 43.05(a)(2), Penal Code; or
4343 (J) burglary under Section 30.02, Penal Code, if:
4444 (i) the offense is punishable under
4545 Subsection (d) of that section because the defendant entered a
4646 habitation with the intent to commit an offense under Section
4747 22.011 or 22.021, Penal Code; and
4848 (ii) during the investigation of the
4949 offense biological matter is collected and the matter:
5050 (a) has not yet been subjected to
5151 forensic DNA testing; or
5252 (b) has been subjected to forensic DNA
5353 testing and the testing results show that the matter does not match
5454 the victim or any other person whose identity is readily
5555 ascertained;
5656 (2) ten years from the date of the commission of the
5757 offense:
5858 (A) theft of any estate, real, personal or mixed,
5959 by an executor, administrator, guardian or trustee, with intent to
6060 defraud any creditor, heir, legatee, ward, distributee,
6161 beneficiary or settlor of a trust interested in such estate;
6262 (B) theft by a public servant of government
6363 property over which the public servant exercises control in the
6464 public servant's official capacity;
6565 (C) forgery or the uttering, using, or passing of
6666 forged instruments;
6767 (D) injury to an elderly or disabled individual
6868 punishable as a felony of the first degree under Section 22.04,
6969 Penal Code;
7070 (E) sexual assault, except as provided by
7171 Subdivision (1) or (7);
7272 (F) arson;
7373 (G) trafficking of persons under Section
7474 20A.02(a)(1), (2), (3), or (4), Penal Code; or
7575 (H) compelling prostitution under Section
7676 43.05(a)(1), Penal Code;
7777 (3) seven years from the date of the commission of the
7878 offense:
7979 (A) misapplication of fiduciary property or
8080 property of a financial institution;
8181 (B) fraudulent securing of document execution;
8282 (C) a felony violation under Chapter 162, Tax
8383 Code;
8484 (D) false statement to obtain property or credit
8585 under Section 32.32, Penal Code;
8686 (E) money laundering;
8787 (F) credit card or debit card abuse under Section
8888 32.31, Penal Code;
8989 (G) fraudulent use or possession of identifying
9090 information under Section 32.51, Penal Code;
9191 (H) exploitation of a child, elderly individual,
9292 or disabled individual under Section 32.53, Penal Code;
9393 (I) health care fraud under Section 35A.02, Penal
9494 Code; or
9595 (J) bigamy under Section 25.01, Penal Code,
9696 except as provided by Subdivision (6);
9797 (4) five years from the date of the commission of the
9898 offense:
9999 (A) theft or robbery;
100100 (B) except as provided by Subdivision (5),
101101 kidnapping [or burglary];
102102 (B-1) except as provided by Subdivision (1) or
103103 (5), burglary;
104104 (C) injury to an elderly or disabled individual
105105 that is not punishable as a felony of the first degree under Section
106106 22.04, Penal Code;
107107 (D) abandoning or endangering a child; or
108108 (E) insurance fraud;
109109 (5) if the investigation of the offense shows that the
110110 victim is younger than 17 years of age at the time the offense is
111111 committed, 20 years from the 18th birthday of the victim of one of
112112 the following offenses:
113113 (A) sexual performance by a child under Section
114114 43.25, Penal Code;
115115 (B) aggravated kidnapping under Section
116116 20.04(a)(4), Penal Code, if the defendant committed the offense
117117 with the intent to violate or abuse the victim sexually; or
118118 (C) subject to Subdivision (1)(J), burglary
119119 under Section 30.02, Penal Code, if the offense is punishable under
120120 Subsection (d) of that section because [and] the defendant entered
121121 a habitation [committed the offense] with the intent to commit an
122122 offense described by Subdivision (1)(B) or (D) of this article or
123123 Paragraph (B) of this subdivision;
124124 (6) ten years from the 18th birthday of the victim of
125125 the offense:
126126 (A) trafficking of persons under Section
127127 20A.02(a)(5) or (6), Penal Code;
128128 (B) injury to a child under Section 22.04, Penal
129129 Code; or
130130 (C) bigamy under Section 25.01, Penal Code, if
131131 the investigation of the offense shows that the person, other than
132132 the legal spouse of the defendant, whom the defendant marries or
133133 purports to marry or with whom the defendant lives under the
134134 appearance of being married is younger than 18 years of age at the
135135 time the offense is committed;
136136 (7) two years from the date the offense was
137137 discovered: sexual assault punishable as a state jail felony under
138138 Section 22.011(f)(2), Penal Code; or
139139 (8) three years from the date of the commission of the
140140 offense: all other felonies.
141141 SECTION 2. The change in law made by this Act does not apply
142142 to an offense if the prosecution of that offense becomes barred by
143143 limitation before the effective date of this Act. The prosecution
144144 of that offense remains barred as if this Act had not taken effect.
145145 SECTION 3. This Act takes effect September 1, 2023.
