55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the restoration of civil rights to a criminal
88 defendant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 48.05(a)(2), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (2) This article applies to:
1313 (A) a federal offense, other than an offense
1414 involving:
1515 (i) violence or the threat of violence;
1616 (ii) drugs; or
1717 (iii) firearms; [and]
1818 (B) an offense under the laws of another country,
1919 other than an offense involving:
2020 (i) violence or the threat of violence;
2121 (ii) drugs; or
2222 (iii) firearms, if the elements of the
2323 offense are substantially similar to elements of an offense under
2424 the laws of this state punishable as a felony; and
2525 (C) an offense under the laws of this state,
2626 other than an offense involving:
2727 (i) violence or the threat of violence;
2828 (ii) drugs; or
2929 (iii) firearms, if the offense is
3030 punishable as a felony.
3131 SECTION 2. Article 48.05(b), Code of Criminal Procedure, is
3232 amended to read as follows:
3333 (b) An individual may not apply for restoration of civil
3434 rights under this article unless:
3535 (1) the individual has completed the sentence for the
3636 offense; and
3737 (2) the conviction occurred[:
3838 [(A)] three or more years before the date of
3939 application[, if the offense is a federal offense; or
4040 [(B) two or more years before the date of
4141 application, if the offense is an offense under the laws of another
4242 country; and
4343 [(3) the individual has not been convicted at any
4444 other time of an offense under the laws of this state, another
4545 state, or the United States].
4646 SECTION 3. This Act applies to a defendant who is convicted
4747 of an offense before, on, or after the effective date of this Act.
4848 SECTION 4. This Act takes effect September 1, 2023.
