55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that school districts and open-enrollment
88 charter schools provide emergency response mapping data to local
99 law enforcement agencies.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 37.108(f), Education Code, is amended to
1212 read as follows:
1313 (f) A school district shall include in its multihazard
1414 emergency operations plan:
1515 (1) a chain of command that designates the individual
1616 responsible for making final decisions during a disaster or
1717 emergency situation and identifies other individuals responsible
1818 for making those decisions if the designated person is unavailable;
1919 (2) provisions that address physical and
2020 psychological safety for responding to a natural disaster, active
2121 shooter, and any other dangerous scenario identified for purposes
2222 of this section by the agency or the Texas School Safety Center;
2323 (3) provisions for ensuring the safety of students in
2424 portable buildings;
2525 (4) provisions for ensuring that students and district
2626 personnel with disabilities are provided equal access to safety
2727 during a disaster or emergency situation;
2828 (5) provisions for providing immediate notification
2929 to parents, guardians, and other persons standing in parental
3030 relation in circumstances involving a significant threat to the
3131 health or safety of students, including identification of the
3232 individual with responsibility for overseeing the notification;
3333 (6) provisions for supporting the psychological
3434 safety of students, district personnel, and the community during
3535 the response and recovery phase following a disaster or emergency
3636 situation that:
3737 (A) are aligned with best practice-based
3838 programs and research-based practices recommended under Section
3939 38.351;
4040 (B) include strategies for ensuring any required
4141 professional development training for suicide prevention and
4242 grief-informed and trauma-informed care is provided to appropriate
4343 school personnel;
4444 (C) include training on integrating
4545 psychological safety and suicide prevention strategies into the
4646 district's plan, such as psychological first aid for schools
4747 training, from an approved list of recommended training established
4848 by the commissioner and Texas School Safety Center for:
4949 (i) members of the district's school safety
5050 and security committee under Section 37.109;
5151 (ii) district school counselors and mental
5252 health professionals; and
5353 (iii) educators and other district
5454 personnel as determined by the district;
5555 (D) include strategies and procedures for
5656 integrating and supporting physical and psychological safety that
5757 align with the provisions described by Subdivision (2); and
5858 (E) implement trauma-informed policies;
5959 (7) a policy for providing a substitute teacher access
6060 to school campus buildings and materials necessary for the
6161 substitute teacher to carry out the duties of a district employee
6262 during an emergency or a mandatory emergency drill; [and]
6363 (8) the name of each individual on the district's
6464 school safety and security committee established under Section
6565 37.109 and the date of each committee meeting during the preceding
6666 year; and
6767 (9) certification that the district is in compliance
6868 with Section 37.116, requiring the district to provide local law
6969 enforcement agencies and emergency first responders emergency
7070 response mapping data for all school campuses and buildings.
7171 SECTION 2. Subchapter D, Chapter 37, Education Code, is
7272 amended by adding Section 37.116 to read as follows:
7373 Sec. 37.116. EMERGENCY RESPONSE MAPPING DATA. (a) For
7474 purposes of this section, "emergency response mapping data" means
7575 information provided in an electronic or digital format to assist a
7676 law enforcement agency or emergency first responder in an
7777 emergency, including:
7878 (1) accurate floor plans overlaid on current aerial
7979 imagery of a school building;
8080 (2) site-specific labeling that matches the structure
8181 of the school building, including:
8282 (A) room labels;
8383 (B) hallway names;
8484 (C) external door and stairwell numbers;
8585 (D) locations of hazards;
8686 (E) key utility locations; and
8787 (F) key boxes;
8888 (3) site-specific labeling that matches the school
8989 grounds, including:
9090 (A) parking areas;
9191 (B) athletic fields;
9292 (C) surrounding roads; and
9393 (D) neighboring roads; and
9494 (4) a standardized gridded overlay with X and Y
9595 coordinates.
9696 (b) Each school district and open-enrollment charter school
9797 shall provide to all appropriate local law enforcement agencies and
9898 emergency first responders emergency response mapping data for each
9999 campus and school building.
100100 (c) The emergency response mapping data provided under
101101 Subsection (b):
102102 (1) must be compatible with software platforms used by
103103 local, state, and federal public safety agencies that provide
104104 emergency services;
105105 (2) must be compatible with software platforms used by
106106 the school district or open-enrollment charter school;
107107 (3) may not require additional software or the
108108 integration of third-party software to view the data;
109109 (4) must be provided in a printable format;
110110 (5) must be verified for accuracy through an annual
111111 walk-through of the school campus or building for which the
112112 information was provided;
113113 (6) must be oriented to true north; and
114114 (7) must contain a standardized grid system to ensure
115115 easy communication by all responders.
116116 (d) A school district or open-enrollment charter school may
117117 use school safety grants made available for the purpose of this
118118 section or funds provided to the district or school through the
119119 school safety allotment under Section 48.115 to comply with this
120120 section.
121121 SECTION 3. This Act takes effect September 1, 2023.
