---|
7 | 7 | | relating to a requirement that school districts and open-enrollment |
---|
8 | 8 | | charter schools provide emergency response mapping data to local |
---|
9 | 9 | | law enforcement agencies. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Section 37.108(f), Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (f) A school district shall include in its multihazard |
---|
14 | 14 | | emergency operations plan: |
---|
15 | 15 | | (1) a chain of command that designates the individual |
---|
16 | 16 | | responsible for making final decisions during a disaster or |
---|
17 | 17 | | emergency situation and identifies other individuals responsible |
---|
18 | 18 | | for making those decisions if the designated person is unavailable; |
---|
19 | 19 | | (2) provisions that address physical and |
---|
20 | 20 | | psychological safety for responding to a natural disaster, active |
---|
21 | 21 | | shooter, and any other dangerous scenario identified for purposes |
---|
22 | 22 | | of this section by the agency or the Texas School Safety Center; |
---|
23 | 23 | | (3) provisions for ensuring the safety of students in |
---|
24 | 24 | | portable buildings; |
---|
25 | 25 | | (4) provisions for ensuring that students and district |
---|
26 | 26 | | personnel with disabilities are provided equal access to safety |
---|
27 | 27 | | during a disaster or emergency situation; |
---|
28 | 28 | | (5) provisions for providing immediate notification |
---|
29 | 29 | | to parents, guardians, and other persons standing in parental |
---|
30 | 30 | | relation in circumstances involving a significant threat to the |
---|
31 | 31 | | health or safety of students, including identification of the |
---|
32 | 32 | | individual with responsibility for overseeing the notification; |
---|
33 | 33 | | (6) provisions for supporting the psychological |
---|
34 | 34 | | safety of students, district personnel, and the community during |
---|
35 | 35 | | the response and recovery phase following a disaster or emergency |
---|
36 | 36 | | situation that: |
---|
37 | 37 | | (A) are aligned with best practice-based |
---|
38 | 38 | | programs and research-based practices recommended under Section |
---|
39 | 39 | | 38.351; |
---|
40 | 40 | | (B) include strategies for ensuring any required |
---|
41 | 41 | | professional development training for suicide prevention and |
---|
42 | 42 | | grief-informed and trauma-informed care is provided to appropriate |
---|
43 | 43 | | school personnel; |
---|
44 | 44 | | (C) include training on integrating |
---|
45 | 45 | | psychological safety and suicide prevention strategies into the |
---|
46 | 46 | | district's plan, such as psychological first aid for schools |
---|
47 | 47 | | training, from an approved list of recommended training established |
---|
48 | 48 | | by the commissioner and Texas School Safety Center for: |
---|
49 | 49 | | (i) members of the district's school safety |
---|
50 | 50 | | and security committee under Section 37.109; |
---|
51 | 51 | | (ii) district school counselors and mental |
---|
52 | 52 | | health professionals; and |
---|
53 | 53 | | (iii) educators and other district |
---|
54 | 54 | | personnel as determined by the district; |
---|
55 | 55 | | (D) include strategies and procedures for |
---|
56 | 56 | | integrating and supporting physical and psychological safety that |
---|
57 | 57 | | align with the provisions described by Subdivision (2); and |
---|
58 | 58 | | (E) implement trauma-informed policies; |
---|
59 | 59 | | (7) a policy for providing a substitute teacher access |
---|
60 | 60 | | to school campus buildings and materials necessary for the |
---|
61 | 61 | | substitute teacher to carry out the duties of a district employee |
---|
62 | 62 | | during an emergency or a mandatory emergency drill; [and] |
---|
63 | 63 | | (8) the name of each individual on the district's |
---|
64 | 64 | | school safety and security committee established under Section |
---|
65 | 65 | | 37.109 and the date of each committee meeting during the preceding |
---|
66 | 66 | | year; and |
---|
67 | 67 | | (9) certification that the district is in compliance |
---|
68 | 68 | | with Section 37.116, requiring the district to provide local law |
---|
69 | 69 | | enforcement agencies and emergency first responders emergency |
---|
70 | 70 | | response mapping data for all school campuses and buildings. |
---|
71 | 71 | | SECTION 2. Subchapter D, Chapter 37, Education Code, is |
---|
72 | 72 | | amended by adding Section 37.116 to read as follows: |
---|
73 | 73 | | Sec. 37.116. EMERGENCY RESPONSE MAPPING DATA. (a) For |
---|
74 | 74 | | purposes of this section, "emergency response mapping data" means |
---|
75 | 75 | | information provided in an electronic or digital format to assist a |
---|
76 | 76 | | law enforcement agency or emergency first responder in an |
---|
77 | 77 | | emergency, including: |
---|
78 | 78 | | (1) accurate floor plans overlaid on current aerial |
---|
79 | 79 | | imagery of a school building; |
---|
80 | 80 | | (2) site-specific labeling that matches the structure |
---|
81 | 81 | | of the school building, including: |
---|
82 | 82 | | (A) room labels; |
---|
83 | 83 | | (B) hallway names; |
---|
84 | 84 | | (C) external door and stairwell numbers; |
---|
85 | 85 | | (D) locations of hazards; |
---|
86 | 86 | | (E) key utility locations; and |
---|
87 | 87 | | (F) key boxes; |
---|
88 | 88 | | (3) site-specific labeling that matches the school |
---|
89 | 89 | | grounds, including: |
---|
90 | 90 | | (A) parking areas; |
---|
91 | 91 | | (B) athletic fields; |
---|
92 | 92 | | (C) surrounding roads; and |
---|
93 | 93 | | (D) neighboring roads; and |
---|
94 | 94 | | (4) a standardized gridded overlay with X and Y |
---|
95 | 95 | | coordinates. |
---|
96 | 96 | | (b) Each school district and open-enrollment charter school |
---|
97 | 97 | | shall provide to all appropriate local law enforcement agencies and |
---|
98 | 98 | | emergency first responders emergency response mapping data for each |
---|
99 | 99 | | campus and school building. |
---|
100 | 100 | | (c) The emergency response mapping data provided under |
---|
101 | 101 | | Subsection (b): |
---|
102 | 102 | | (1) must be compatible with software platforms used by |
---|
103 | 103 | | local, state, and federal public safety agencies that provide |
---|
104 | 104 | | emergency services; |
---|
105 | 105 | | (2) must be compatible with software platforms used by |
---|
106 | 106 | | the school district or open-enrollment charter school; |
---|
107 | 107 | | (3) may not require additional software or the |
---|
108 | 108 | | integration of third-party software to view the data; |
---|
109 | 109 | | (4) must be provided in a printable format; |
---|
110 | 110 | | (5) must be verified for accuracy through an annual |
---|
111 | 111 | | walk-through of the school campus or building for which the |
---|
112 | 112 | | information was provided; |
---|
113 | 113 | | (6) must be oriented to true north; and |
---|
114 | 114 | | (7) must contain a standardized grid system to ensure |
---|
115 | 115 | | easy communication by all responders. |
---|
116 | 116 | | (d) A school district or open-enrollment charter school may |
---|
117 | 117 | | use school safety grants made available for the purpose of this |
---|
118 | 118 | | section or funds provided to the district or school through the |
---|
119 | 119 | | school safety allotment under Section 48.115 to comply with this |
---|
120 | 120 | | section. |
---|
121 | 121 | | SECTION 3. This Act takes effect September 1, 2023. |
