7 | 7 | | relating to the creation and use of the electricity supply chain |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 38.201, Utilities Code, is amended by |
---|
11 | 11 | | amending Subsections (a), (b), and (c) and adding Subsection (a-1) |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (a) In this subchapter, "electricity supply chain" means: |
---|
14 | 14 | | (1) facilities and methods used for producing, |
---|
15 | 15 | | treating, processing, pressurizing, storing, or transporting |
---|
16 | 16 | | natural gas for delivery to electric generation facilities; [and] |
---|
17 | 17 | | (2) critical infrastructure necessary to maintain |
---|
18 | 18 | | electricity service; and |
---|
19 | 19 | | (3) roads necessary to access facilities in the |
---|
20 | 20 | | electricity supply chain. |
---|
21 | 21 | | (a-1) A reference in this subchapter to the "electricity |
---|
22 | 22 | | supply chain" includes water and wastewater treatment plants. |
---|
23 | 23 | | (b) The Texas Electricity Supply Chain Security and Mapping |
---|
24 | 24 | | Committee is established to: |
---|
25 | 25 | | (1) map this state's electricity supply chain; |
---|
26 | 26 | | (2) identify critical infrastructure sources in the |
---|
27 | 27 | | electricity supply chain; |
---|
28 | 28 | | (3) establish best practices to prepare facilities |
---|
29 | 29 | | [that provide electric service and natural gas service] in the |
---|
30 | 30 | | electricity supply chain to maintain service in an extreme weather |
---|
31 | 31 | | event and recommend oversight and compliance standards for those |
---|
32 | 32 | | facilities; and |
---|
33 | 33 | | (4) designate priority service needs to prepare for, |
---|
34 | 34 | | respond to, and recover from an extreme weather event. |
---|
35 | 35 | | (c) The committee is composed of: |
---|
36 | 36 | | (1) the executive director of the commission; |
---|
37 | 37 | | (2) the executive director of the Railroad Commission |
---|
38 | 38 | | of Texas; |
---|
39 | 39 | | (3) the president and the chief executive officer of |
---|
40 | 40 | | the independent organization certified under Section 39.151 for the |
---|
41 | 41 | | ERCOT power region; [and] |
---|
42 | 42 | | (4) the chief of the Texas Division of Emergency |
---|
43 | 43 | | Management; and |
---|
44 | 44 | | (5) the executive director of the Texas Department of |
---|
45 | 45 | | Transportation. |
---|
46 | 46 | | SECTION 2. Section 38.202(c), Utilities Code, is amended to |
---|
47 | 47 | | read as follows: |
---|
48 | 48 | | (c) The commission, the Railroad Commission of Texas, [and] |
---|
49 | 49 | | the Texas Division of Emergency Management, and the Texas |
---|
50 | 50 | | Department of Transportation shall provide staff as necessary to |
---|
51 | 51 | | assist the committee in carrying out the committee's duties and |
---|
52 | 52 | | responsibilities. |
---|
53 | 53 | | SECTION 3. Sections 38.203(a) and (e), Utilities Code, are |
---|
54 | 54 | | amended to read as follows: |
---|
55 | 55 | | (a) The committee shall: |
---|
56 | 56 | | (1) map the state's electricity supply chain in order |
---|
57 | 57 | | to designate priority electricity service needs during extreme |
---|
58 | 58 | | weather events; |
---|
59 | 59 | | (2) identify and designate the sources in the |
---|
60 | 60 | | electricity supply chain necessary to operate critical |
---|
61 | 61 | | infrastructure, as defined by Section 421.001, Government Code; |
---|
62 | 62 | | (3) develop a communication system between critical |
---|
63 | 63 | | infrastructure sources, the commission, and the independent |
---|
64 | 64 | | organization certified under Section 39.151 for the ERCOT power |
---|
65 | 65 | | region to ensure that electricity and natural gas supplies in the |
---|
66 | 66 | | electricity supply chain are prioritized to those sources during an |
---|
67 | 67 | | extreme weather event; and |
---|
68 | 68 | | (4) establish best practices to prepare facilities |
---|
69 | 69 | | [that provide electric service and natural gas service] in the |
---|
70 | 70 | | electricity supply chain to maintain service in an extreme weather |
---|
71 | 71 | | event and recommend oversight and compliance standards for those |
---|
72 | 72 | | facilities. |
---|
73 | 73 | | (e) The committee shall provide [the Texas Energy |
---|
74 | 74 | | Reliability Council with] access to the electricity supply chain |
---|
75 | 75 | | map to: |
---|
76 | 76 | | (1) the Texas Energy Reliability Council; and |
---|
77 | 77 | | (2) Texas Department of Transportation staff whose |
---|
78 | 78 | | duties include making repairs after disasters or emergencies. |
---|
79 | 79 | | SECTION 4. This Act takes effect September 1, 2023. |
