66 AN ACT
77 relating to the creation and use of the electricity supply chain
88 map.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.201, Utilities Code, is amended by
1111 amending Subsections (a), (b), and (c) and adding Subsection (a-1)
1212 to read as follows:
1313 (a) In this subchapter, "electricity supply chain" means:
1414 (1) facilities and methods used for producing,
1515 treating, processing, pressurizing, storing, or transporting
1616 natural gas for delivery to electric generation facilities; [and]
1717 (2) critical infrastructure necessary to maintain
1818 electricity service; and
1919 (3) roads necessary to access facilities in the
2020 electricity supply chain.
2121 (a-1) A reference in this subchapter to the "electricity
2222 supply chain" includes water and wastewater treatment plants.
2323 (b) The Texas Electricity Supply Chain Security and Mapping
2424 Committee is established to:
2525 (1) map this state's electricity supply chain;
2626 (2) identify critical infrastructure sources in the
2727 electricity supply chain;
2828 (3) establish best practices to prepare facilities
2929 [that provide electric service and natural gas service] in the
3030 electricity supply chain to maintain service in an extreme weather
3131 event and recommend oversight and compliance standards for those
3232 facilities; and
3333 (4) designate priority service needs to prepare for,
3434 respond to, and recover from an extreme weather event.
3535 (c) The committee is composed of:
3636 (1) the executive director of the commission;
3737 (2) the executive director of the Railroad Commission
3838 of Texas;
3939 (3) the president and the chief executive officer of
4040 the independent organization certified under Section 39.151 for the
4141 ERCOT power region; [and]
4242 (4) the chief of the Texas Division of Emergency
4343 Management; and
4444 (5) the executive director of the Texas Department of
4545 Transportation.
4646 SECTION 2. Section 38.202(c), Utilities Code, is amended to
4747 read as follows:
4848 (c) The commission, the Railroad Commission of Texas, [and]
4949 the Texas Division of Emergency Management, and the Texas
5050 Department of Transportation shall provide staff as necessary to
5151 assist the committee in carrying out the committee's duties and
5252 responsibilities.
5353 SECTION 3. Sections 38.203(a) and (e), Utilities Code, are
5454 amended to read as follows:
5555 (a) The committee shall:
5656 (1) map the state's electricity supply chain in order
5757 to designate priority electricity service needs during extreme
5858 weather events;
5959 (2) identify and designate the sources in the
6060 electricity supply chain necessary to operate critical
6161 infrastructure, as defined by Section 421.001, Government Code;
6262 (3) develop a communication system between critical
6363 infrastructure sources, the commission, and the independent
6464 organization certified under Section 39.151 for the ERCOT power
6565 region to ensure that electricity and natural gas supplies in the
6666 electricity supply chain are prioritized to those sources during an
6767 extreme weather event; and
6868 (4) establish best practices to prepare facilities
6969 [that provide electric service and natural gas service] in the
7070 electricity supply chain to maintain service in an extreme weather
7171 event and recommend oversight and compliance standards for those
7272 facilities.
7373 (e) The committee shall provide [the Texas Energy
7474 Reliability Council with] access to the electricity supply chain
7575 map to:
7676 (1) the Texas Energy Reliability Council; and
7777 (2) Texas Department of Transportation staff whose
7878 duties include making repairs after disasters or emergencies.
7979 SECTION 4. This Act takes effect September 1, 2023.
