9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The heading to Chapter 1954, Insurance Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | CHAPTER 1954. INSURANCE FOR DIGITAL [TRANSPORTATION] NETWORK |
---|
13 | 13 | | COMPANY DRIVERS |
---|
14 | 14 | | SECTION 2. Section 1954.001, Insurance Code, is amended to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | Sec. 1954.001. DEFINITIONS. In this chapter: |
---|
17 | 17 | | (1) "Delivery available period" means the period when |
---|
18 | 18 | | a driver: |
---|
19 | 19 | | (A) has logged on to a digital network and is |
---|
20 | 20 | | available to receive requests to provide delivery services from a |
---|
21 | 21 | | delivery network company; |
---|
22 | 22 | | (B) is operating a personal vehicle; and |
---|
23 | 23 | | (C) is not providing delivery services or |
---|
24 | 24 | | operating in the delivery service period. |
---|
25 | 25 | | (2) "Delivery network company" means a corporation, |
---|
26 | 26 | | partnership, sole proprietorship, or other entity operating in this |
---|
27 | 27 | | state that uses a digital network to connect a delivery network |
---|
28 | 28 | | company customer to a delivery network company driver to provide |
---|
29 | 29 | | delivery services. |
---|
30 | 30 | | (3) "Delivery network company customer" means a person |
---|
31 | 31 | | who orders the delivery of goods that are delivered by a delivery |
---|
32 | 32 | | network company driver at the direction of the person. |
---|
33 | 33 | | (4) "Delivery network company driver" means an |
---|
34 | 34 | | individual who provides delivery services through a delivery |
---|
35 | 35 | | network company's digital network using a personal vehicle. |
---|
36 | 36 | | (5) "Delivery service period" means the period: |
---|
37 | 37 | | (A) beginning when a delivery network company |
---|
38 | 38 | | driver begins operating a personal vehicle on the way to pick up |
---|
39 | 39 | | goods for a delivery or series of deliveries as documented through a |
---|
40 | 40 | | digital network controlled by a delivery network company; |
---|
41 | 41 | | (B) continuing while the driver transports the |
---|
42 | 42 | | requested goods; and |
---|
43 | 43 | | (C) ending on delivery of the requested goods to: |
---|
44 | 44 | | (i) the delivery network company customer |
---|
45 | 45 | | or the last customer in a series of deliveries; |
---|
46 | 46 | | (ii) a location designated by the customer |
---|
47 | 47 | | or arrival at the last location designated in a series of |
---|
48 | 48 | | deliveries; or |
---|
49 | 49 | | (iii) a location designated by the company, |
---|
50 | 50 | | including for purposes of returning the goods. |
---|
51 | 51 | | (6) "Delivery services" means the fulfillment of |
---|
52 | 52 | | delivery requests made by a delivery network company customer |
---|
53 | 53 | | through a digital network, including the pickup and delivery of |
---|
54 | 54 | | goods. The term includes a series of deliveries to different |
---|
55 | 55 | | customers or to different locations at the direction of a customer. |
---|
56 | 56 | | (7) "Digital network" means any online-enabled |
---|
57 | 57 | | application, software, website, or system offered or used by a |
---|
58 | 58 | | digital [transportation] network company that enables: |
---|
59 | 59 | | (A) a prearranged ride with a transportation |
---|
60 | 60 | | network company driver; or |
---|
61 | 61 | | (B) delivery services from a delivery network |
---|
62 | 62 | | company driver. |
---|
63 | 63 | | (8) "Digital network company" means a delivery network |
---|
64 | 64 | | company or transportation network company. |
---|
65 | 65 | | (9) "Digital network company driver" means a delivery |
---|
66 | 66 | | network company driver or transportation network company driver. |
---|
67 | 67 | | (10) [(2)] "Personal vehicle" means a vehicle that is |
---|
68 | 68 | | used by a digital [transportation] network company driver and is: |
---|
69 | 69 | | (A) owned, leased, or otherwise authorized for |
---|
70 | 70 | | use by the driver; and |
---|
71 | 71 | | (B) not a taxicab, limousine, or similar for-hire |
---|
72 | 72 | | vehicle. |
---|
73 | 73 | | (11) [(3)] "Prearranged ride" means transportation |
---|
74 | 74 | | provided by a transportation network company driver to a |
---|
75 | 75 | | transportation network company rider, beginning at the time a |
---|
76 | 76 | | driver accepts a ride requested by a rider through a digital network |
---|
77 | 77 | | controlled by a transportation network company and ending at the |
---|
78 | 78 | | time the last requesting rider departs from the driver's personal |
---|
79 | 79 | | vehicle. The term does not include: |
---|
80 | 80 | | (A) a shared expense carpool or vanpool |
---|
81 | 81 | | arrangement or service; or |
---|
82 | 82 | | (B) transportation provided using a taxicab, |
---|
83 | 83 | | limousine, or similar for-hire vehicle. |
---|
84 | 84 | | (12) [(4)] "Transportation network company" means a |
---|
85 | 85 | | corporation, partnership, sole proprietorship, or other entity |
---|
86 | 86 | | operating in this state that uses a digital network to connect a |
---|
87 | 87 | | transportation network company rider to a transportation network |
---|
88 | 88 | | company driver for a prearranged ride. |
---|
89 | 89 | | (13) [(5)] "Transportation network company driver" |
---|
90 | 90 | | means an individual who: |
---|
91 | 91 | | (A) receives connections to potential |
---|
92 | 92 | | transportation network company riders and related services from a |
---|
93 | 93 | | transportation network company in exchange for payment of a fee to |
---|
94 | 94 | | the company; and |
---|
95 | 95 | | (B) uses a personal vehicle to offer or provide a |
---|
96 | 96 | | prearranged ride to a transportation network company rider on |
---|
97 | 97 | | connection with the rider through a digital network controlled by |
---|
98 | 98 | | the company in exchange for compensation or payment of a fee. |
---|
99 | 99 | | (14) [(6)] "Transportation network company rider" |
---|
100 | 100 | | means an individual who uses a transportation network company's |
---|
101 | 101 | | digital network to connect with a transportation network company |
---|
102 | 102 | | driver who provides a prearranged ride to the individual in the |
---|
103 | 103 | | driver's personal vehicle between points chosen by the individual. |
---|
104 | 104 | | SECTION 3. Subchapter A, Chapter 1954, Insurance Code, is |
---|
105 | 105 | | amended by adding Sections 1954.003 and 1954.004 to read as |
---|
106 | 106 | | follows: |
---|
107 | 107 | | Sec. 1954.003. APPLICABILITY OF OTHER LAW. This chapter |
---|
108 | 108 | | does not limit the scope of federal or state law regarding delivery |
---|
109 | 109 | | or transport of goods. A person providing a delivery service that is |
---|
110 | 110 | | subject to other law shall comply with the other law. In the event |
---|
111 | 111 | | of a conflict between this chapter and the other law, the other law |
---|
112 | 112 | | prevails. |
---|
113 | 113 | | Sec. 1954.004. CONSTRUCTION OF CHAPTER. This chapter may |
---|
114 | 114 | | not be construed to invalidate, limit, or restrict: |
---|
115 | 115 | | (1) an automobile insurer's ability under the law to |
---|
116 | 116 | | write an insurance policy; or |
---|
117 | 117 | | (2) an automobile insurer's ability under the law to |
---|
118 | 118 | | cancel or not renew an insurance policy. |
---|
119 | 119 | | SECTION 4. Section 1954.051, Insurance Code, is amended by |
---|
120 | 120 | | amending Subsections (a) and (d) and adding Subsection (b-1) to |
---|
121 | 121 | | read as follows: |
---|
122 | 122 | | (a) A digital [transportation] network company driver or |
---|
123 | 123 | | digital [transportation] network company on the driver's behalf |
---|
124 | 124 | | shall maintain primary automobile insurance as required by this |
---|
125 | 125 | | subchapter. |
---|
126 | 126 | | (b-1) Insurance maintained under this subchapter must allow |
---|
127 | 127 | | a delivery network company driver to use a personal vehicle to |
---|
128 | 128 | | provide delivery services for compensation and cover the driver |
---|
129 | 129 | | during the delivery available period, if applicable, and delivery |
---|
130 | 130 | | service period. |
---|
131 | 131 | | (d) The coverage requirements of this subchapter may be |
---|
132 | 132 | | satisfied by: |
---|
133 | 133 | | (1) automobile insurance maintained by the digital |
---|
134 | 134 | | [transportation] network company driver; |
---|
135 | 135 | | (2) automobile insurance maintained by the digital |
---|
136 | 136 | | [transportation] network company; or |
---|
137 | 137 | | (3) a combination of Subdivisions (1) and (2). |
---|
138 | 138 | | SECTION 5. Subchapter B, Chapter 1954, Insurance Code, is |
---|
139 | 139 | | amended by adding Section 1954.0535 to read as follows: |
---|
140 | 140 | | Sec. 1954.0535. INSURANCE REQUIREMENTS: DELIVERY AVAILABLE |
---|
141 | 141 | | PERIOD AND DELIVERY SERVICE PERIOD. During the delivery available |
---|
142 | 142 | | period and delivery service period, the automobile insurance policy |
---|
143 | 143 | | must provide: |
---|
144 | 144 | | (1) the following minimum amounts of liability |
---|
145 | 145 | | insurance coverage: |
---|
146 | 146 | | (A) $50,000 for bodily injury to or death of each |
---|
147 | 147 | | person in an incident; |
---|
148 | 148 | | (B) $100,000 for bodily injury to or death of a |
---|
149 | 149 | | person per incident; and |
---|
150 | 150 | | (C) $25,000 for damage to or destruction of |
---|
151 | 151 | | property of others in an incident; |
---|
152 | 152 | | (2) uninsured or underinsured motorist coverage where |
---|
153 | 153 | | required by Section 1952.101; and |
---|
154 | 154 | | (3) personal injury protection coverage where |
---|
155 | 155 | | required by Section 1952.152. |
---|
156 | 156 | | SECTION 6. Sections 1954.054 and 1954.055, Insurance Code, |
---|
157 | 157 | | are amended to read as follows: |
---|
158 | 158 | | Sec. 1954.054. LAPSE OF OR INSUFFICIENT COVERAGE. If an |
---|
159 | 159 | | insurance policy maintained by a digital [transportation] network |
---|
160 | 160 | | company driver under this subchapter has lapsed or does not provide |
---|
161 | 161 | | the coverage required by this subchapter, the digital |
---|
162 | 162 | | [transportation] network company shall provide the coverage |
---|
163 | 163 | | required by this subchapter beginning with the first dollar of a |
---|
164 | 164 | | claim against the driver. |
---|
165 | 165 | | Sec. 1954.055. RELATION TO PERSONAL AUTOMOBILE |
---|
166 | 166 | | INSURANCE. Coverage under an automobile insurance policy |
---|
167 | 167 | | maintained by a digital [the transportation] network company is not |
---|
168 | 168 | | contingent on a digital [transportation] network company driver's |
---|
169 | 169 | | personal automobile insurer initially denying a claim. |
---|
170 | 170 | | SECTION 7. Section 1954.056(b), Insurance Code, is amended |
---|
171 | 171 | | to read as follows: |
---|
172 | 172 | | (b) A digital [transportation] network company driver shall |
---|
173 | 173 | | carry proof of insurance that satisfies Sections 1954.052 and |
---|
174 | 174 | | 1954.053 or Section 1954.0535, as applicable, with the driver when |
---|
175 | 175 | | the driver uses a vehicle in connection with a digital |
---|
176 | 176 | | [transportation] network company's digital network. In the event |
---|
177 | 177 | | of an accident, a driver shall provide the proof of insurance to a |
---|
178 | 178 | | directly interested person, automobile insurer, and investigating |
---|
179 | 179 | | peace officer on request under Section 601.053, Transportation |
---|
180 | 180 | | Code. On request, a driver shall also disclose to a directly |
---|
181 | 181 | | interested person, automobile insurer, and investigating peace |
---|
182 | 182 | | officer whether, at the time of the accident, the driver was, as |
---|
183 | 183 | | applicable: |
---|
184 | 184 | | (1) logged on to the transportation network company's |
---|
185 | 185 | | digital network[;] or |
---|
186 | 186 | | [(2)] engaged in a prearranged ride; or |
---|
187 | 187 | | (2) logged on to the delivery network company's |
---|
188 | 188 | | digital network during a delivery available period or delivery |
---|
189 | 189 | | service period. |
---|

207 | 207 | | policy may not provide coverage, depending on the policy's terms, |

208 | 208 | | while the driver is logged on to, as applicable: |
---|
209 | 209 | | (A) the transportation network company's digital |
---|
210 | 210 | | network and is available to receive transportation requests or is |
---|
211 | 211 | | engaged in a prearranged ride; or |
---|
212 | 212 | | (B) the delivery network company's digital |
---|
213 | 213 | | network during the delivery available period or delivery service |
---|
214 | 214 | | period. |
---|
215 | 215 | | Sec. 1954.102. CONTROL OF DIGITAL [TRANSPORTATION] NETWORK |
---|
216 | 216 | | COMPANY DRIVERS. A digital [transportation] network company does |
---|
217 | 217 | | not control, direct, or manage a personal vehicle or a digital |
---|
218 | 218 | | [transportation] network company driver who connects to the |
---|
219 | 219 | | company's digital network except as agreed by written contract. |
---|
220 | 220 | | SECTION 10. Section 1954.151(a), Insurance Code, is amended |

233 | 233 | | SECTION 11. Section 1954.152(a), Insurance Code, is amended |

244 | 244 | | (4) the driver otherwise uses a vehicle to transport |

246 | 246 | | SECTION 12. Section 1954.153(b), Insurance Code, is amended |

---|
255 | 255 | | SECTION 13. Sections 1954.154 and 1954.155, Insurance Code, |
---|
256 | 256 | | are amended to read as follows: |
---|
257 | 257 | | Sec. 1954.154. ASSISTANCE IN CLAIM INVESTIGATION. In an |
---|
258 | 258 | | insurance claim investigation, a digital [transportation] network |
---|
259 | 259 | | company and any insurer providing coverage under Subchapter B shall |
---|
260 | 260 | | assist each insurer involved in the claim by providing information |
---|
261 | 261 | | to directly interested persons and an insurer of the digital |
---|
262 | 262 | | [transportation] network company driver. Information provided |
---|
263 | 263 | | under this section must include: |
---|
264 | 264 | | (1) the precise times that, as applicable: |
---|
265 | 265 | | (A) a driver logged on and off of the |
---|
266 | 266 | | transportation network company's digital network in the 12-hour |
---|
267 | 267 | | period immediately preceding and the 12-hour period immediately |
---|
268 | 268 | | following the accident; or |
---|
269 | 269 | | (B) a driver began and ended the delivery |
---|
270 | 270 | | available period and delivery service period on the delivery |
---|
271 | 271 | | network company's digital network in the 12-hour period immediately |
---|
272 | 272 | | preceding and the 12-hour period immediately following the |
---|
273 | 273 | | accident; and |
---|
274 | 274 | | (2) a clear description of the coverage, exclusions, |
---|
275 | 275 | | and limits provided under an automobile insurance policy maintained |
---|
276 | 276 | | under Subchapter B. |
---|
277 | 277 | | Sec. 1954.155. PAYMENT OF CERTAIN CLAIMS. If there is a |
---|
278 | 278 | | lien on a personal vehicle and the digital [transportation] network |
---|
279 | 279 | | company's insurer covers a claim arising out of an incident that |
---|
280 | 280 | | occurred during a prearranged ride or delivery available period or |
---|
281 | 281 | | delivery service period, as applicable, the insurer shall issue |
---|
282 | 282 | | payment for the claim: |
---|
283 | 283 | | (1) directly to the person who is repairing the |
---|
284 | 284 | | vehicle; or |
---|
285 | 285 | | (2) jointly to the owner of the personal vehicle and |
---|
286 | 286 | | the primary lienholder. |
---|
287 | 287 | | SECTION 14. This Act takes effect January 1, 2024. |
