66 AN ACT
77 relating to eligibility to receive certain federal funding for
88 postsecondary career and technology education distributed by the
99 Texas Higher Education Coordinating Board.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1212 amended by adding Section 61.0761 to read as follows:
1313 Sec. 61.0761. CAREER AND TECHNOLOGY EDUCATION GRANTS. (a)
1414 In this section, "ability to benefit career and technology
1515 education program" means a postsecondary career and technology
1616 education program in which a person who does not have a high school
1717 diploma or equivalency certificate and who both qualifies for
1818 federal student financial aid and demonstrates on an assessment
1919 instrument that the person can pass college-level courses with some
2020 support may enroll.
2121 (b) In establishing criteria for postsecondary career and
2222 technology education funding provided under the Carl D. Perkins
2323 Vocational and Technical Education Act of 1998 (20 U.S.C. Section
2424 2301 et seq.), the board shall, to the extent permitted under that
2525 law, ensure that noncredit and ability to benefit career and
2626 technology education programs are eligible to receive funding.
2727 SECTION 2. This Act takes effect September 1, 2023.
