10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
---|
12 | 12 | | amended by adding Section 61.0761 to read as follows: |

13 | 13 | | Sec. 61.0761. CAREER AND TECHNOLOGY EDUCATION GRANTS. (a) |
---|
14 | 14 | | In this section, "ability to benefit career and technology |
---|
15 | 15 | | education program" means a postsecondary career and technology |
---|
16 | 16 | | education program in which a person who does not have a high school |
---|
17 | 17 | | diploma or equivalency certificate and who both qualifies for |
---|
18 | 18 | | federal student financial aid and demonstrates on an assessment |
---|
19 | 19 | | instrument that the person can pass college-level courses with some |
---|
20 | 20 | | support may enroll. |
---|
21 | 21 | | (b) In establishing criteria for postsecondary career and |
---|
22 | 22 | | technology education funding provided under the Carl D. Perkins |
---|
23 | 23 | | Vocational and Technical Education Act of 1998 (20 U.S.C. Section |
---|
24 | 24 | | 2301 et seq.), the board shall, to the extent permitted under that |
---|
25 | 25 | | law, ensure that noncredit and ability to benefit career and |
---|
26 | 26 | | technology education programs are eligible to receive funding. |
---|
27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
