55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the compilation and reporting of statistics involving
88 sexual assault victims who receive a forensic medical examination
99 before reporting the assault to law enforcement.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter G, Chapter 56A, Code of Criminal
1212 Procedure, is amended by adding Article 56A.3031 to read as
1313 follows:
1414 Art. 56A.3031. DELAYED REPORTING BY SEXUAL ASSAULT VICTIMS;
1515 COMPILATION OF STATISTICS. (a) In this article, "department"
1616 means the Department of Public Safety.
1717 (b) The department shall compile and maintain statistics on
1818 the number of victims of sexual assault in each calendar year who
1919 have reported the sexual assault to a law enforcement agency after
2020 receiving a forensic medical examination under Article 56A.303,
2121 regardless of the year in which that examination was performed.
2222 Statistics compiled and maintained under this subsection may not
2323 include identifying information of a victim.
2424 (c) Not later than September 1 of each even-numbered year,
2525 the department shall:
2626 (1) report the statistics compiled by the department
2727 under Subsection (b) to the standing committees of the house of
2828 representatives and senate with primary jurisdiction over criminal
2929 justice issues; and
3030 (2) post the statistics compiled by the department
3131 under Subsection (b) on the department's Internet website.
3232 SECTION 2. This Act takes effect September 1, 2023.
