66 relating to minimum standards for entry safety point protocols and
77 infrastructure for school districts and charter schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter G, Chapter 37, Education Code, is
1010 amended by adding Section 37.2072 to read as follows:
1111 Sec. 37.2072. MINIMUM STANDARDS FOR SCHOOL ENTRY POINT
1212 PROTOCOLS AND INFRASTRUCTURE. (a) The center shall develop
1313 minimum standards for reducing and securing school entry points in
1414 order to ensure that the security standards for instructional
1515 facilities and other school district and charter school facilities
1616 provide for a safe environment.
1717 (b) The minimum standards for reducing entry points
1818 developed pursuant to Subsection (a) shall include:
1919 (1) determining the minimum number of open entry
2020 points required to allow for efficient ingress of students and
2121 faculty for the start of a school day and limiting the number of
2222 open entry points to that minimum;
2323 (2) further reducing the total number of open entry
2424 points to the greatest extent possible once the initial entry of
2525 students and faculty for the start of a school day has been
2626 completed;
2727 (3) securing all other points of access so as to not
2828 allow entry while still allowing students and faculty to exit in the
2929 event of an emergency; and
3030 (4) remotely monitoring other points of access by use
3131 of access controls, camera systems, or other devices determined by
3232 the school district or charter school to be effective and feasible.
3333 (c) The minimum standards for securing entry points
3434 developed pursuant to Subsection (a) shall be divided into four
3535 levels based upon the specific needs and available resources of a
3636 school district or charter school. The levels shall be delineated
3737 as follows:
3838 (1) Level One shall provide for visual surveillance of
3939 the entry point by school security personnel or school staff to
4040 monitor for unusual behavior while applying questioning,
4141 individual searches, and bag checks when deemed warranted;
4242 (2) Level Two shall include all of the practices
4343 described in Level One, as well as performing random checks of
4444 entrants by school security personnel or school staff utilizing
4545 handheld metal detectors;
4646 (3) Level Three shall include establishing security
4747 screening during which entrants and their belongings would be
4848 randomly screened by walk through metal detectors, as well as
4949 applying all of the practices described in Level One and using
5050 handheld metal detectors for secondary screening; and
5151 (4) Level Four shall entail comprehensive security
5252 screening of all entrants and their belongings, including applying
5353 all of the practices described in Level One; screening all entrants
5454 through the use of walk through metal detectors; using handheld
5555 metal detectors for secondary screening; conducting bag checks in
5656 only those instances in which the alarm in the walk through metal
5757 detector sounds; and instructing entrants to use low metal content
5858 backpacks and school supplies to mitigate the alarms and maintain
5959 efficient ingress.
6060 SECTION 2. This Act takes effect September 1, 2023.
