7 | 7 | | infrastructure for school districts and charter schools. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter G, Chapter 37, Education Code, is |
---|
10 | 10 | | amended by adding Section 37.2072 to read as follows: |
---|
11 | 11 | | Sec. 37.2072. MINIMUM STANDARDS FOR SCHOOL ENTRY POINT |
---|
12 | 12 | | PROTOCOLS AND INFRASTRUCTURE. (a) The center shall develop |
---|
13 | 13 | | minimum standards for reducing and securing school entry points in |
---|
14 | 14 | | order to ensure that the security standards for instructional |
---|
15 | 15 | | facilities and other school district and charter school facilities |
---|
16 | 16 | | provide for a safe environment. |
---|
17 | 17 | | (b) The minimum standards for reducing entry points |
---|
18 | 18 | | developed pursuant to Subsection (a) shall include: |
---|
19 | 19 | | (1) determining the minimum number of open entry |
---|
20 | 20 | | points required to allow for efficient ingress of students and |
---|
21 | 21 | | faculty for the start of a school day and limiting the number of |
---|
22 | 22 | | open entry points to that minimum; |
---|
23 | 23 | | (2) further reducing the total number of open entry |
---|
24 | 24 | | points to the greatest extent possible once the initial entry of |
---|
25 | 25 | | students and faculty for the start of a school day has been |
---|
26 | 26 | | completed; |
---|
27 | 27 | | (3) securing all other points of access so as to not |
---|
28 | 28 | | allow entry while still allowing students and faculty to exit in the |
---|
29 | 29 | | event of an emergency; and |
---|
30 | 30 | | (4) remotely monitoring other points of access by use |
---|
31 | 31 | | of access controls, camera systems, or other devices determined by |
---|
32 | 32 | | the school district or charter school to be effective and feasible. |
---|
33 | 33 | | (c) The minimum standards for securing entry points |
---|
34 | 34 | | developed pursuant to Subsection (a) shall be divided into four |
---|
35 | 35 | | levels based upon the specific needs and available resources of a |
---|
36 | 36 | | school district or charter school. The levels shall be delineated |
---|
37 | 37 | | as follows: |
---|
38 | 38 | | (1) Level One shall provide for visual surveillance of |
---|
39 | 39 | | the entry point by school security personnel or school staff to |
---|
40 | 40 | | monitor for unusual behavior while applying questioning, |
---|
41 | 41 | | individual searches, and bag checks when deemed warranted; |
---|
42 | 42 | | (2) Level Two shall include all of the practices |
---|
43 | 43 | | described in Level One, as well as performing random checks of |
---|
44 | 44 | | entrants by school security personnel or school staff utilizing |
---|
45 | 45 | | handheld metal detectors; |
---|
46 | 46 | | (3) Level Three shall include establishing security |
---|
47 | 47 | | screening during which entrants and their belongings would be |
---|
48 | 48 | | randomly screened by walk through metal detectors, as well as |
---|
49 | 49 | | applying all of the practices described in Level One and using |
---|
50 | 50 | | handheld metal detectors for secondary screening; and |
---|
51 | 51 | | (4) Level Four shall entail comprehensive security |
---|
52 | 52 | | screening of all entrants and their belongings, including applying |
---|
53 | 53 | | all of the practices described in Level One; screening all entrants |
---|
54 | 54 | | through the use of walk through metal detectors; using handheld |
---|
55 | 55 | | metal detectors for secondary screening; conducting bag checks in |
---|
56 | 56 | | only those instances in which the alarm in the walk through metal |
---|
57 | 57 | | detector sounds; and instructing entrants to use low metal content |
---|
58 | 58 | | backpacks and school supplies to mitigate the alarms and maintain |
---|
59 | 59 | | efficient ingress. |
---|
60 | 60 | | SECTION 2. This Act takes effect September 1, 2023. |
---|
