| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 8.054(d), Family Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (d) The continuation of maintenance ordered under |
|---|
| 11 | 11 | | Subsection (b) is subject to the procedural requirements for a |
|---|
| 12 | 12 | | motion to modify as provided by Section 8.057. |
|---|
| 13 | 13 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 14 | 14 | | motion to continue spousal maintenance under Subchapter B, Chapter |
|---|
| 15 | 15 | | 8, Family Code, that is made on or after the effective date of this |
|---|
| 16 | 16 | | Act, regardless of whether the original spousal maintenance order |
|---|
| 17 | 17 | | was rendered before, on, or after that date. |
|---|
| 18 | 18 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 19 | 19 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 20 | 20 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 21 | 21 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 22 | 22 | | Act takes effect September 1, 2023. |
