55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prohibition on the possession of a firearm by a
88 person following the person's conviction of certain family violence
99 misdemeanors.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 46.04(b), Penal Code, is amended to read
1212 as follows:
1313 (b) A person who has been convicted of an offense under
1414 Section 22.01, punishable as a Class A misdemeanor and committed
1515 against an individual whose relationship to or association with the
1616 person is described by Section 71.0021(b), 71.003, or 71.005,
1717 Family Code [involving a member of the person's family or
1818 household], commits an offense if the person possesses a firearm
1919 before the fifth anniversary of the later of:
2020 (1) the date of the person's release from confinement
2121 following conviction of the misdemeanor; or
2222 (2) the date of the person's release from community
2323 supervision following conviction of the misdemeanor.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect on the date the offense was committed,
2828 and the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense was
3131 committed before that date.
3232 SECTION 3. This Act takes effect September 1, 2023.
