66 AN ACT
77 relating to fireworks sales to the public by retail fireworks
88 permit holders in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2154.202(g), Occupations Code, is
1111 amended to read as follows:
1212 (g) Except as provided by Subsection (h), a retail fireworks
1313 permit holder may sell fireworks only to the public, and only during
1414 periods:
1515 (1) beginning June 24 and ending at midnight on July 4;
1616 (2) beginning December 20 and ending at midnight on
1717 January 1 of the following year; and
1818 (3) beginning May 1 and ending at midnight on May 5 if
1919 the fireworks are sold at a location that is not more than 150 [100]
2020 miles from the Texas-Mexico border and that is in a county in which
2121 the commissioners court of the county has approved the sale of
2222 fireworks during the period.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
