11 | 11 | | and mental health for certain public high school students. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter A, Chapter 28, Education Code, is |
---|
14 | 14 | | amended by adding Section 28.0121 to read as follows: |
---|
15 | 15 | | Sec. 28.0121. ELECTIVE COURSE ON COMMUNITY SAFETY, FIREARM |
---|
16 | 16 | | SAFETY, AND MENTAL HEALTH. (a) A school district or |
---|
17 | 17 | | open-enrollment charter school may offer to students in grade 12 an |
---|
18 | 18 | | elective course on community safety, firearm safety, and mental |
---|
19 | 19 | | health that meets the requirements for an elective credit under |
---|
20 | 20 | | Section 28.025. |
---|
21 | 21 | | (b) A course under this section must include: |
---|
22 | 22 | | (1) during the first half of the course for which a |
---|
23 | 23 | | student may earn one-half elective credit, instruction relating to: |
---|
24 | 24 | | (A) family violence prevention, including |
---|
25 | 25 | | relevant family violence education; |
---|
26 | 26 | | (B) sexual assault prevention, including |
---|
27 | 27 | | relevant sexual assault education; |
---|
28 | 28 | | (C) self-defense tactics; and |
---|
29 | 29 | | (D) mental health education; and |
---|
30 | 30 | | (2) during the second half of the course for which a |
---|
31 | 31 | | student may earn one-half elective credit: |
---|
32 | 32 | | (A) instruction relating to firearm safety, |
---|
33 | 33 | | including relevant firearm education; |
---|
34 | 34 | | (B) information on state and federal laws |
---|
35 | 35 | | governing the use of firearms; and |
---|
36 | 36 | | (C) information contained in the classroom |
---|
37 | 37 | | instruction portion of the handgun proficiency course described by |
---|
38 | 38 | | Section 411.188, Government Code. |
---|
39 | 39 | | (c) A student may not enroll in the second half of a course |
---|
40 | 40 | | under this section unless the student has satisfactorily completed |
---|
41 | 41 | | the first half of the course. |
---|
42 | 42 | | (d) If during the course of instruction, a student enrolled |
---|
43 | 43 | | in a course under this section discloses to a teacher that the |
---|
44 | 44 | | student has been a victim of or is experiencing issues relating to |
---|
45 | 45 | | family violence, sexual assault, or mental health, the teacher |
---|
46 | 46 | | shall provide the student with information regarding appropriately |
---|
47 | 47 | | licensed health professionals. |
---|
48 | 48 | | SECTION 2. This Act applies beginning with the 2024-2025 |
---|
49 | 49 | | school year. |
---|
50 | 50 | | SECTION 3. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2023. |
