88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to an elective course on community safety, firearm safety,
1111 and mental health for certain public high school students.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1414 amended by adding Section 28.0121 to read as follows:
1515 Sec. 28.0121. ELECTIVE COURSE ON COMMUNITY SAFETY, FIREARM
1616 SAFETY, AND MENTAL HEALTH. (a) A school district or
1717 open-enrollment charter school may offer to students in grade 12 an
1818 elective course on community safety, firearm safety, and mental
1919 health that meets the requirements for an elective credit under
2020 Section 28.025.
2121 (b) A course under this section must include:
2222 (1) during the first half of the course for which a
2323 student may earn one-half elective credit, instruction relating to:
2424 (A) family violence prevention, including
2525 relevant family violence education;
2626 (B) sexual assault prevention, including
2727 relevant sexual assault education;
2828 (C) self-defense tactics; and
2929 (D) mental health education; and
3030 (2) during the second half of the course for which a
3131 student may earn one-half elective credit:
3232 (A) instruction relating to firearm safety,
3333 including relevant firearm education;
3434 (B) information on state and federal laws
3535 governing the use of firearms; and
3636 (C) information contained in the classroom
3737 instruction portion of the handgun proficiency course described by
3838 Section 411.188, Government Code.
3939 (c) A student may not enroll in the second half of a course
4040 under this section unless the student has satisfactorily completed
4141 the first half of the course.
4242 (d) If during the course of instruction, a student enrolled
4343 in a course under this section discloses to a teacher that the
4444 student has been a victim of or is experiencing issues relating to
4545 family violence, sexual assault, or mental health, the teacher
4646 shall provide the student with information regarding appropriately
4747 licensed health professionals.
4848 SECTION 2. This Act applies beginning with the 2024-2025
4949 school year.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2023.
