55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the grade levels at which human sexuality instruction
88 may be provided in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004, Education Code, is amended by
1111 amending Subsection (c) and adding Subsection (f-1) to read as
1212 follows:
1313 (c) The local school health advisory council's duties
1414 include recommending:
1515 (1) the number of hours of instruction to be provided
1616 in:
1717 (A) health education in kindergarten through
1818 grade eight; and
1919 (B) if the school district requires health
2020 education for high school graduation, health education, including
2121 physical health education and mental health education, in grades 9
2222 through 12;
2323 (2) policies, procedures, strategies, and curriculum
2424 appropriate for specific grade levels designed to prevent physical
2525 health concerns, including obesity, cardiovascular disease, Type 2
2626 diabetes, and mental health concerns, including suicide, through
2727 coordination of:
2828 (A) health education, which must address
2929 physical health concerns and mental health concerns to ensure the
3030 integration of physical health education and mental health
3131 education;
3232 (B) physical education and physical activity;
3333 (C) nutrition services;
3434 (D) parental involvement;
3535 (E) instruction on substance abuse prevention;
3636 (F) school health services, including mental
3737 health services;
3838 (G) a comprehensive school counseling program
3939 under Section 33.005;
4040 (H) a safe and healthy school environment; and
4141 (I) school employee wellness;
4242 (3) appropriate grade levels in grades five through 12
4343 and methods of instruction for human sexuality instruction;
4444 (4) strategies for integrating the curriculum
4545 components specified by Subdivision (2) with the following elements
4646 in a coordinated school health program for the district:
4747 (A) school health services, including physical
4848 health services and mental health services, if provided at a campus
4949 by the district or by a third party under a contract with the
5050 district;
5151 (B) a comprehensive school counseling program
5252 under Section 33.005;
5353 (C) a safe and healthy school environment; and
5454 (D) school employee wellness;
5555 (5) if feasible, joint use agreements or strategies
5656 for collaboration between the school district and community
5757 organizations or agencies;
5858 (6) strategies to increase parental awareness
5959 regarding:
6060 (A) risky behaviors and early warning signs of
6161 suicide risks and behavioral health concerns, including mental
6262 health disorders and substance use disorders; and
6363 (B) available community programs and services
6464 that address risky behaviors, suicide risks, and behavioral health
6565 concerns;
6666 (7) appropriate grade levels and curriculum for
6767 instruction regarding opioid addiction and abuse and methods of
6868 administering an opioid antagonist, as defined by Section 483.101,
6969 Health and Safety Code; and
7070 (8) appropriate grade levels and curriculum for
7171 instruction regarding child abuse, family violence, dating
7272 violence, and sex trafficking, including likely warning signs that
7373 a child may be at risk for sex trafficking, provided that the local
7474 school health advisory council's recommendations under this
7575 subdivision do not conflict with the essential knowledge and skills
7676 developed by the State Board of Education under this subchapter.
7777 (f-1) A school district may not provide human sexuality
7878 instruction to students in prekindergarten through grade four.
7979 SECTION 2. This Act applies beginning with the 2023-2024
8080 school year.
8181 SECTION 3. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2023.
