66 AN ACT
77 relating to the implementation of student and family engagement
88 plans by school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1111 amended by adding Section 29.927 to read as follows:
1212 Sec. 29.927. STUDENT AND FAMILY ENGAGEMENT PLANS. (a) Each
1313 school district shall develop and implement a student and family
1414 engagement plan for students in each grade level from
1515 prekindergarten through grade 12 to assist the district in:
1616 (1) achieving and maintaining high levels of family
1717 involvement and positive family attitudes toward public education;
1818 (2) strengthening relationships between students,
1919 families, district administrators, and teachers;
2020 (3) creating positive outcomes by increasing positive
2121 student engagement and developing the student's sense of connection
2222 to the student's learning environment, including by ensuring that
2323 the student is:
2424 (A) actively involved in the student's academic
2525 achievement; and
2626 (B) positively motivated to attend school
2727 regularly and graduate;
2828 (4) creating opportunities for parents to engage with
2929 and be directly involved in their child's education; and
3030 (5) creating a communal campus environment that
3131 includes students, families, teachers, district staff, and
3232 community-based organizations that provide resources to students
3333 for social-emotional and academic development.
3434 (b) The student and family engagement plans must be based on
3535 student and parent engagement strategies that:
3636 (1) are evidence-based and supported by empirical
3737 research;
3838 (2) establish a system of communication, updated
3939 annually based on a district assessment of parent and communication
4040 needs, between students, families, and school districts that
4141 includes mailed, electronic, and virtual communications, such as
4242 phone calls, text messaging, virtual conferences, and e-mail;
4343 (3) provide support for students who are attending
4444 school in-person or virtually through counselors, teachers, and
4545 district staff;
4646 (4) use diagnostic tools to evaluate the emotional,
4747 behavioral, and cognitive engagement of students and communicate
4848 the results to the family of the student;
4949 (5) include regular meetings with interested persons,
5050 including community-based organizations, throughout the school
5151 year regarding the development and implementation of the engagement
5252 plans;
5353 (6) are proven to demonstrate significant positive
5454 short-term and long-term outcomes for early childhood, elementary,
5555 middle school, and high school education;
5656 (7) include programs and interventions that engage a
5757 family in supporting a student's learning at home;
5858 (8) include programming that is accessible by students
5959 and families who are bilingual or emergent bilingual;
6060 (9) are proven to demonstrate solutions that build
6161 long-lasting generational relationships between school districts
6262 and families; and
6363 (10) support virtual or remote learning by promoting
6464 digital communication and literacy and by ensuring that students
6565 have access to devices and broadband Internet.
6666 (c) Each school district shall ensure that student and
6767 family engagement plans are consistent with the public education
6868 mission and objectives described by Section 4.001 and accessible to
6969 students who are educationally disadvantaged.
7070 (d) In developing student and family engagement plans, a
7171 school district must collaborate with campus leaders, educators,
7272 teachers, families, and students at all grade levels to include in
7373 the student and family engagement plans the strategies described by
7474 Subsection (b). A school district must provide for a student at the
7575 middle or high school level to be directly involved in developing
7676 student engagement plans.
7777 (e) The agency shall offer administrative support and
7878 resources to assist school districts with developing and
7979 implementing student and family engagement plans as provided by
8080 this section.
8181 (f) Not later than the 30th instructional day following the
8282 first day of school, each school district shall post the student and
8383 family engagement plans on the district's Internet website.
8484 (g) The agency shall collaborate with other state agencies
8585 to coordinate and streamline the process for accessing information,
8686 support, and resources included in a school district's family
8787 engagement plan.
8888 (h) A parent-teacher organization or community-based
8989 organization may submit:
9090 (1) to the agency recommendations regarding the
9191 establishment of family engagement strategies; and
9292 (2) to a school district recommendations regarding the
9393 development of a student and family engagement plan.
9494 (i) The agency, in establishing family engagement
9595 strategies, or a school district, in establishing a student and
9696 family engagement plan, shall consider any recommendations
9797 submitted under Subsection (h).
9898 (j) Each school district shall review the student and family
9999 engagement plans annually and update the plans at least once every
100100 two years.
101101 SECTION 2. Section 29.934(d), Education Code, is amended to
102102 read as follows:
103103 (d) To be designated as a resource campus, the campus must:
104104 (1) implement a targeted improvement plan as described
105105 by Chapter 39A and establish a school community partnership team;
106106 (2) adopt an accelerated campus excellence turnaround
107107 plan as provided by Section 39A.105(b) except that a classroom
108108 teacher who satisfies the requirements for demonstrated
109109 instructional effectiveness under Section 39A.105(b)(3) must also
110110 hold a current designation assigned under Section 21.3521;
111111 (3) be in a school district that has adopted an
112112 approved local optional teacher designation system under Section
113113 21.3521;
114114 (4) satisfy certain staff criteria by:
115115 (A) requiring a principal or teacher employed at
116116 the campus before the designation to apply for a position to
117117 continue at the campus;
118118 (B) employing only teachers who have at least
119119 three years of teaching experience;
120120 (C) employing at least one school counselor for
121121 every 300 students; and
122122 (D) employing at least one appropriately
123123 licensed professional to assist with the social and emotional needs
124124 of students and staff, who must be a:
125125 (i) family and community liaison;
126126 (ii) clinical social worker;
127127 (iii) specialist in school psychology; or
128128 (iv) professional counselor;
129129 (5) implement a positive behavior program as provided
130130 by Section 37.0013;
131131 (6) implement a student and family engagement plan as
132132 described by Section 29.927 [29.168];
133133 (7) develop and implement a plan to use high quality
134134 instructional materials;
135135 (8) if the campus is an elementary campus, operate the
136136 campus for a school year that qualifies for funding under Section
137137 48.0051; and
138138 (9) annually submit to the commissioner data and
139139 information required by the commissioner to assess fidelity of
140140 implementation.
141141 SECTION 3. Section 29.168, Education Code, is repealed.
142142 SECTION 4. This Act takes effect immediately if it receives
143143 a vote of two-thirds of all the members elected to each house, as
144144 provided by Section 39, Article III, Texas Constitution. If this
145145 Act does not receive the vote necessary for immediate effect, this
146146 Act takes effect September 1, 2023.
