55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing certain political subdivisions to change
88 the date on which the general election for officers is held.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 41.0052, Election Code, is amended by
1111 adding Subsections (a-1) and (a-2) to read as follows:
1212 (a-1) The governing body of a political subdivision, other
1313 than a county or municipal utility district, that holds its general
1414 election for officers on the November uniform election date may,
1515 not later than December 31, 2024, change the date on which it holds
1616 its general election for officers to the May uniform election date.
1717 (a-2) Subsection (a-1) applies only to a municipality:
1818 (1) with a population of more than 30,000;
1919 (2) through which State Highway 121 runs; and
2020 (3) that is wholly located in a county with a
2121 population of more than 500,000 that borders two counties, each of
2222 which has a population of more than 2 million.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
