| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 41.0052, Election Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (a-1) and (a-2) to read as follows: |
|---|
| 12 | 12 | | (a-1) The governing body of a political subdivision, other |
|---|
| 13 | 13 | | than a county or municipal utility district, that holds its general |
|---|
| 14 | 14 | | election for officers on the November uniform election date may, |
|---|
| 15 | 15 | | not later than December 31, 2024, change the date on which it holds |
|---|
| 16 | 16 | | its general election for officers to the May uniform election date. |
|---|
| 17 | 17 | | (a-2) Subsection (a-1) applies only to a municipality: |
|---|
| 18 | 18 | | (1) with a population of more than 30,000; |
|---|
| 19 | 19 | | (2) through which State Highway 121 runs; and |
|---|
| 20 | 20 | | (3) that is wholly located in a county with a |
|---|
| 21 | 21 | | population of more than 500,000 that borders two counties, each of |
|---|
| 22 | 22 | | which has a population of more than 2 million. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
