| 7 | 7 | | relating to the enforcement of commercial motor vehicle safety |

| 8 | 8 | | standards in certain municipalities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 644.101(b), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) A police officer of any of the following municipalities |
|---|
| 13 | 13 | | is eligible to apply for certification under this section: |
|---|
| 14 | 14 | | (1) a municipality with a population of 50,000 or |
|---|
| 15 | 15 | | more; |
|---|
| 16 | 16 | | (2) a municipality with a population of 25,000 or more |
|---|
| 17 | 17 | | any part of which is located in a county with a population of |
|---|
| 18 | 18 | | 500,000 or more; |
|---|
| 19 | 19 | | (3) a municipality with a population of less than |
|---|
| 20 | 20 | | 25,000: |
|---|
| 21 | 21 | | (A) any part of which is located in a county with |
|---|
| 22 | 22 | | a population of 3.3 million; and |
|---|
| 23 | 23 | | (B) that contains or is adjacent to an |
|---|
| 24 | 24 | | international port; |
|---|
| 25 | 25 | | (4) a municipality with a population of at least |
|---|
| 26 | 26 | | 34,000 that is located in a county that borders two or more states; |
|---|
| 27 | 27 | | (5) a municipality any part of which is located in a |
|---|
| 28 | 28 | | county bordering the United Mexican States; |
|---|
| 29 | 29 | | (6) a municipality with a population of less than |
|---|
| 30 | 30 | | 5,000 that is located: |
|---|
| 31 | 31 | | (A) adjacent to a bay connected to the Gulf of |
|---|
| 32 | 32 | | Mexico; and |
|---|
| 33 | 33 | | (B) in a county adjacent to a county with a |
|---|
| 34 | 34 | | population greater than 3.3 million; |
|---|
| 35 | 35 | | (7) a municipality that is located: |
|---|
| 36 | 36 | | (A) within 25 miles of an international port; and |
|---|
| 37 | 37 | | (B) in a county that does not contain a highway |
|---|
| 38 | 38 | | that is part of the national system of interstate and defense |
|---|
| 39 | 39 | | highways and is adjacent to a county with a population greater than |
|---|
| 40 | 40 | | 3.3 million; |
|---|
| 41 | 41 | | (8) a municipality with a population of less than |
|---|
| 42 | 42 | | 8,500 that: |
|---|
| 43 | 43 | | (A) is the county seat; and |
|---|
| 44 | 44 | | (B) contains a highway that is part of the |
|---|
| 45 | 45 | | national system of interstate and defense highways; |
|---|
| 46 | 46 | | (9) a municipality located in a county with a |
|---|
| 47 | 47 | | population between 60,000 and 66,000 adjacent to a bay connected to |
|---|
| 48 | 48 | | the Gulf of Mexico; |
|---|
| 49 | 49 | | (10) a municipality with a population of more than |
|---|
| 50 | 50 | | 40,000 and less than 50,000 that is located in a county with a |
|---|
| 51 | 51 | | population of more than 285,000 and less than 300,000 that borders |
|---|
| 52 | 52 | | the Gulf of Mexico; |
|---|
| 53 | 53 | | (11) a municipality with a population between 32,000 |
|---|
| 54 | 54 | | and 50,000 that is located entirely in a county that: |
|---|
| 55 | 55 | | (A) has a population of less than 250,000; |
|---|
| 56 | 56 | | (B) is adjacent to two counties that each have a |
|---|
| 57 | 57 | | population of more than 1.2 million; and |
|---|
| 58 | 58 | | (C) contains two highways that are part of the |
|---|
| 59 | 59 | | national system of interstate and defense highways; |
|---|
| 60 | 60 | | (12) a municipality with a population of more than |
|---|
| 61 | 61 | | 3,000 and less than 10,000 that: |
|---|
| 62 | 62 | | (A) contains a highway that is part of the |
|---|
| 63 | 63 | | national system of interstate and defense highways; and |
|---|
| 64 | 64 | | (B) is located in a county with a population |
|---|
| 65 | 65 | | between 150,000 and 155,000; |
|---|
| 66 | 66 | | (13) a municipality with a population of less than |
|---|
| 67 | 67 | | 75,000 that is located in three counties, at least one of which has |
|---|
| 68 | 68 | | a population greater than 3.3 million; |
|---|
| 69 | 69 | | (14) a municipality with a population between 14,000 |
|---|
| 70 | 70 | | and 17,000 that: |
|---|
| 71 | 71 | | (A) contains three or more numbered United States |
|---|
| 72 | 72 | | highways; and |
|---|
| 73 | 73 | | (B) is located in a county that is adjacent to a |
|---|
| 74 | 74 | | county with a population of more than 200,000; [or] |
|---|
| 75 | 75 | | (15) a municipality with a population of less than |
|---|
| 76 | 76 | | 50,000 that is located in: |
|---|
| 77 | 77 | | (A) a county that generated $20 million or more |
|---|
| 78 | 78 | | in tax revenue collected under Chapters 201 and 202, Tax Code, from |
|---|
| 79 | 79 | | oil and gas production during the preceding state fiscal year; or |
|---|
| 80 | 80 | | (B) a county that is adjacent to two or more |
|---|
| 81 | 81 | | counties described by Paragraph (A); or |
|---|
| 82 | 82 | | (16) a municipality with a population of more than |
|---|
| 83 | 83 | | 25,000 and less than 50,000 that: |
|---|
| 84 | 84 | | (A) is located in a county with a population of |
|---|
| 85 | 85 | | more than 150,000 and less than 200,000; and |
|---|
| 86 | 86 | | (B) contains a toll project of a regional tollway |
|---|
| 87 | 87 | | authority under Chapter 366 and a highway that is part of the |
|---|
| 88 | 88 | | national system of interstate and defense highways. |
|---|
| 89 | 89 | | SECTION 2. This Act takes effect September 1, 2023. |
