| 12 | 12 | SECTION 1. Section 86.044(h), Natural Resources Code, is | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | (h) If the commission determines that a person has violated | |
| 15 | 15 | a rule adopted under this section, the commission shall notify the | |
| 16 | 16 | attorney general of a violation that is not remedied in a reasonable | |
| 17 | 17 | amount of time. The attorney general may [shall] initiate a suit | |
| 18 | 18 | to recover a penalty for the violation in the manner provided by | |
| 19 | 19 | Subchapter G. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2023. |
