| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 212.028, Election Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subsection (b), a petition for an |
|---|
| 13 | 13 | | initial recount must be submitted by 5 p.m. of the third business |
|---|
| 14 | 14 | | [second] day after the date the canvassing authority to whose |
|---|
| 15 | 15 | | presiding officer the petition must be submitted completes its |
|---|
| 16 | 16 | | canvass of the original election returns. |
|---|
| 17 | 17 | | (c) If the deadline for submitting a petition for an initial |
|---|
| 18 | 18 | | recount falls on a Saturday, Sunday, or legal state holiday, the |
|---|
| 19 | 19 | | deadline is extended to 10 a.m. of the next regular business day. |
|---|
| 20 | 20 | | SECTION 2. Section 212.083, Election Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | Sec. 212.083. DEADLINE FOR SUBMITTING PETITION. The |
|---|
| 23 | 23 | | deadline for submitting a recount petition under this subchapter is |
|---|
| 24 | 24 | | 2 p.m. of the second [first] day after the date of the local |
|---|
| 25 | 25 | | canvass. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2023. |
