66 AN ACT
77 relating to reports to the legislature on administrative hearings
88 conducted by the State Office of Administrative Hearings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 2003, Government Code, is
1111 amended by adding Section 2003.058 to read as follows:
1212 Sec. 2003.058. QUARTERLY REPORTS TO LEGISLATURE. (a) Not
1313 later than the 30th day following the end of each calendar quarter,
1414 the office shall submit a report to the legislature indicating for
1515 each county the total number of administrative hearings decided by
1616 the office during the previous calendar quarter and, of those
1717 hearings:
1818 (1) the percentage in which the administrative law
1919 judge decided in favor of the person who requested the hearing; and
2020 (2) the percentage in which the administrative law
2121 judge decided in favor of a state agency.
2222 (b) Not later than the 30th day following the end of each
2323 calendar quarter, each state agency shall submit a report to the
2424 legislature indicating the total number of appeals from
2525 administrative hearings held by the office that were decided during
2626 the previous calendar quarter and, of those appeals:
2727 (1) the percentage in which the court decided in favor
2828 of the person who requested the hearing; and
2929 (2) the percentage in which the court decided in favor
3030 of the state agency.
3131 SECTION 2. The State Office of Administrative Hearings and
3232 each state agency subject to Section 2003.058, Government Code, as
3333 added by this Act, shall submit the initial reports required by that
3434 section not later than January 30, 2024, based on data from the
3535 previous calendar quarter.
3636 SECTION 3. This Act takes effect September 1, 2023.
