| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 2003, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2003.058 to read as follows: |
|---|
| 12 | 12 | | Sec. 2003.058. QUARTERLY REPORTS TO LEGISLATURE. (a) Not |
|---|
| 13 | 13 | | later than the 30th day following the end of each calendar quarter, |
|---|
| 14 | 14 | | the office shall submit a report to the legislature indicating for |
|---|
| 15 | 15 | | each county the total number of administrative hearings decided by |
|---|
| 16 | 16 | | the office during the previous calendar quarter and, of those |
|---|
| 17 | 17 | | hearings: |
|---|
| 18 | 18 | | (1) the percentage in which the administrative law |
|---|
| 19 | 19 | | judge decided in favor of the person who requested the hearing; and |
|---|
| 20 | 20 | | (2) the percentage in which the administrative law |
|---|
| 21 | 21 | | judge decided in favor of a state agency. |
|---|
| 22 | 22 | | (b) Not later than the 30th day following the end of each |
|---|
| 23 | 23 | | calendar quarter, each state agency shall submit a report to the |
|---|
| 24 | 24 | | legislature indicating the total number of appeals from |
|---|
| 25 | 25 | | administrative hearings held by the office that were decided during |
|---|
| 26 | 26 | | the previous calendar quarter and, of those appeals: |
|---|
| 27 | 27 | | (1) the percentage in which the court decided in favor |
|---|
| 28 | 28 | | of the person who requested the hearing; and |
|---|
| 29 | 29 | | (2) the percentage in which the court decided in favor |
|---|
| 30 | 30 | | of the state agency. |
|---|
| 31 | 31 | | SECTION 2. The State Office of Administrative Hearings and |
|---|
| 32 | 32 | | each state agency subject to Section 2003.058, Government Code, as |
|---|
| 33 | 33 | | added by this Act, shall submit the initial reports required by that |
|---|
| 34 | 34 | | section not later than January 30, 2024, based on data from the |
|---|
| 35 | 35 | | previous calendar quarter. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2023. |
