| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Subchapter B, Chapter 372, Transportation Code, |
|---|
| 8 | 8 | | is amended by adding Section 372.0555 to read as follows: |
|---|
| 9 | 9 | | Sec. 372.0555. NOTICE OF RETURNED PAYMENT. A toll project |
|---|
| 10 | 10 | | entity must immediately notify the holder of an electronic toll |
|---|
| 11 | 11 | | collection customer account that a payment by the credit card or |
|---|
| 12 | 12 | | debit card associated with the account was declined or could not |
|---|
| 13 | 13 | | otherwise be processed. |
|---|
| 14 | 14 | | SECTION 2. Section 372.056, Transportation Code, is amended |
|---|
| 15 | 15 | | to read as follows: |
|---|
| 16 | 16 | | Sec. 372.056. INFORMATION REQUIRED ON NOTICE OR INVOICE. |
|---|
| 17 | 17 | | (a) A notice or an invoice of unpaid tolls sent by a toll project |
|---|
| 18 | 18 | | entity must clearly state that the document is a bill and the |
|---|
| 19 | 19 | | recipient is expected to pay the amount indicated. |
|---|
| 20 | 20 | | (b) A notice or an invoice of unpaid tolls sent by first |
|---|
| 21 | 21 | | class mail must clearly indicate on the outside of the envelope that |
|---|
| 22 | 22 | | the document enclosed is a bill and the recipient is expected to pay |
|---|
| 23 | 23 | | the amount indicated. |
|---|
| 24 | 24 | | SECTION 3. Section 372.057(a), Transportation Code, is |
|---|
| 25 | 25 | | amended to read as follows: |
|---|
| 26 | 26 | | (a) An invoice or notice provided to a person by a toll |
|---|
| 27 | 27 | | project entity may be provided by: |
|---|
| 28 | 28 | | (1) first class mail; [or] |
|---|
| 29 | 29 | | (2) e-mail if the person has provided an e-mail |
|---|
| 30 | 30 | | address to the entity and has elected to receive notice |
|---|
| 31 | 31 | | electronically; or |
|---|
| 32 | 32 | | (3) text message if the person has provided a phone |
|---|
| 33 | 33 | | number to the entity and has elected to receive notice by text |
|---|
| 34 | 34 | | message. |
|---|
| 35 | 35 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 36 | 36 | | to the collection of a toll incurred on or after the effective date |
|---|
| 37 | 37 | | of this Act. The collection of a toll incurred before the effective |
|---|
| 38 | 38 | | date of this Act is governed by the law in effect immediately before |
|---|
| 39 | 39 | | the effective date of this Act, and that law is continued in effect |
|---|
| 40 | 40 | | for that purpose. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2023. |
