| 11 | 11 | SECTION 1. Section 202.010, Property Code, is amended by | |
| 12 | 12 | adding Subsection (b-1) and amending Subsection (c) to read as | |
| 13 | 13 | follows: | |
| 14 | 14 | (b-1) A property owners' association may not include or | |
| 15 | 15 | enforce a provision in a dedicatory instrument that requires a | |
| 16 | 16 | residential property owner to pay a fee for the review or approval | |
| 17 | 17 | of a proposed solar energy device installation. | |
| 18 | 18 | (c) A provision that violates Subsection (b) or (b-1) is | |
| 19 | 19 | void. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2023. |
