55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the addition of a service readiness component to the
88 college, career, or military readiness outcomes bonus under the
99 Foundation School Program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 12.263(e), Education Code, as effective
1212 September 1, 2023, is amended to read as follows:
1313 (e) For purposes of the college, career, [or] military, or
1414 service readiness outcomes bonus under Section 48.110,
1515 notwithstanding Subsection (f) of that section, an annual graduate
1616 of an adult education program operated under a charter granted
1717 under this subchapter demonstrates career readiness by earning an
1818 industry-accepted certificate not later than six months after
1919 completing the program.
2020 SECTION 2. The heading to Section 48.110, Education Code,
2121 is amended to read as follows:
2222 Sec. 48.110. COLLEGE, CAREER, [OR] MILITARY, OR SERVICE
2323 READINESS OUTCOMES BONUS.
2424 SECTION 3. Sections 48.110(b), (c), (d), (f), (g), and (i),
2525 Education Code, are amended to read as follows:
2626 (b) For purposes of the outcomes bonus under this section,
2727 the commissioner shall determine the threshold percentage as
2828 provided by Subsection (g) for college, career, [or] military, or
2929 service readiness as described by Subsection (f) for each of the
3030 following cohorts:
3131 (1) annual graduates who are educationally
3232 disadvantaged;
3333 (2) annual graduates who are not educationally
3434 disadvantaged; and
3535 (3) annual graduates who are enrolled in a special
3636 education program under Subchapter A, Chapter 29, regardless of
3737 whether the annual graduates are educationally disadvantaged.
3838 (c) Each year, the commissioner shall determine for each
3939 school district the minimum number of annual graduates in each
4040 cohort described by Subsection (b) who would have to demonstrate
4141 college, career, [or] military, or service readiness as described
4242 by Subsection (f) in order for the district to achieve a percentage
4343 of college, career, [or] military, or service readiness for that
4444 cohort equal to the threshold percentage established for that
4545 cohort under Subsection (b).
4646 (d) For each annual graduate in a cohort described by
4747 Subsection (b) who demonstrates college, career, [or] military, or
4848 service readiness as described by Subsection (f) in excess of the
4949 minimum number of students determined for the applicable district
5050 cohort under Subsection (c), a school district is entitled to an
5151 annual outcomes bonus of:
5252 (1) if the annual graduate is educationally
5353 disadvantaged, $5,000;
5454 (2) if the annual graduate is not educationally
5555 disadvantaged, $3,000; and
5656 (3) if the annual graduate is enrolled in a special
5757 education program under Subchapter A, Chapter 29, $2,000,
5858 regardless of whether the annual graduate is educationally
5959 disadvantaged.
6060 (f) For purposes of this section, an annual graduate
6161 demonstrates:
6262 (1) college readiness if the annual graduate:
6363 (A) both:
6464 (i) achieves college readiness standards
6565 used for accountability purposes under Chapter 39 on the ACT, the
6666 SAT, or an assessment instrument designated by the Texas Higher
6767 Education Coordinating Board under Section 51.334; and
6868 (ii) during a time period established by
6969 commissioner rule, enrolls at a postsecondary educational
7070 institution; or
7171 (B) earns an associate degree from a
7272 postsecondary educational institution approved by the Texas Higher
7373 Education Coordinating Board while attending high school or during
7474 a time period established by commissioner rule;
7575 (2) career readiness if the annual graduate:
7676 (A) achieves college readiness standards used
7777 for accountability purposes under Chapter 39 on the ACT, the SAT, or
7878 an assessment instrument designated by the Texas Higher Education
7979 Coordinating Board under Section 51.334; and
8080 (B) during a time period established by
8181 commissioner rule, earns an industry-accepted certificate; [and]
8282 (3) military readiness if the annual graduate:
8383 (A) achieves a passing score set by the
8484 applicable military branch on the Armed Services Vocational
8585 Aptitude Battery; and
8686 (B) during a time period established by
8787 commissioner rule, enlists in the armed forces of the United States
8888 or the Texas National Guard; and
8989 (4) service readiness if the annual graduate enrolls
9090 in an AmeriCorps program not later than the last day of the seventh
9191 month after graduation from high school.
9292 (g) The commissioner shall establish the threshold
9393 percentages under Subsection (b) using the 25th percentile of
9494 statewide college, career, [or] military, or service readiness as
9595 described by Subsection (f) for the applicable cohort of annual
9696 graduates during the 2016-2017 school year.
9797 (i) At least 55 percent of the funds allocated under this
9898 section must be used in grades 8 through 12 to improve college,
9999 career, [and] military, and service readiness outcomes as described
100100 by Subsection (f).
101101 SECTION 4. This Act takes effect September 1, 2023.
