6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 7 | | SECTION 1. Section 1701.310, Occupations Code, is amended |
---|
8 | 8 | | by amending Subsection (b) and adding Subsections (b-1), (b-2), and |
---|
9 | 9 | | (b-3) to read as follows: |
---|
10 | 10 | | (b) A county jailer appointed on a temporary basis who does |
---|
11 | 11 | | not satisfactorily complete the preparatory training program |
---|
12 | 12 | | before the first anniversary of the date that the person is |
---|
13 | 13 | | appointed shall be removed from the position. A county jailer |
---|
14 | 14 | | appointed on a temporary basis shall be enrolled in the preparatory |
---|
15 | 15 | | training program on or before the 90th day after their temporary |
---|
16 | 16 | | appointment. A temporary appointment may not be renewed, except |
---|
17 | 17 | | that the sheriff may petition the commission to extend the |
---|
18 | 18 | | temporary appointment for a period not to exceed six months. |
---|
19 | 19 | | (b-1) A person who has previously been appointed on a |
---|
20 | 20 | | temporary basis as a county jailer and separated from that position |
---|
21 | 21 | | may be subsequently appointed on a temporary basis as a county |
---|
22 | 22 | | jailer under Subsection (b) at the same or a different county jail |
---|
23 | 23 | | only if the person was in good standing at the time the person |
---|
24 | 24 | | separated from the position. |
---|
25 | 25 | | (b-2) A person who has cumulatively served as a county |
---|
26 | 26 | | jailer on a temporary basis under Subsection (b) for two years may |
---|
27 | 27 | | continue to serve for the remainder of that temporary appointment, |
---|
28 | 28 | | not to exceed the first anniversary of the date of the most recent |
---|
29 | 29 | | appointment. The person is not eligible for an extension of that |
---|
30 | 30 | | appointment or for a subsequent appointment on a temporary basis as |
---|
31 | 31 | | a county jailer under that subsection at the same or a different |
---|
32 | 32 | | county jail until the first anniversary of the date the person |
---|
33 | 33 | | separates from the temporary appointment during which the person |
---|
34 | 34 | | reached two years of cumulative service. |
---|
35 | 35 | | (b-3) A person whose county jailer license has become |
---|
36 | 36 | | inactive may be appointed as a county jailer on a temporary basis |
---|
37 | 37 | | under Subsection (b). |
---|
38 | 38 | | SECTION 2. As soon as practicable after the effective date |
---|
39 | 39 | | of this Act, the Texas Commission on Law Enforcement shall adopt the |
---|
40 | 40 | | rules necessary to implement the changes in law made by this Act to |
---|
41 | 41 | | Section 1701.310, Occupations Code. |
---|
42 | 42 | | SECTION 3. This Act takes effect September 1, 2023. |
