55 relating to the temporary appointment of county jailers.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 1701.310, Occupations Code, is amended
88 by amending Subsection (b) and adding Subsections (b-1), (b-2), and
99 (b-3) to read as follows:
1010 (b) A county jailer appointed on a temporary basis who does
1111 not satisfactorily complete the preparatory training program
1212 before the first anniversary of the date that the person is
1313 appointed shall be removed from the position. A county jailer
1414 appointed on a temporary basis shall be enrolled in the preparatory
1515 training program on or before the 90th day after their temporary
1616 appointment. A temporary appointment may not be renewed, except
1717 that the sheriff may petition the commission to extend the
1818 temporary appointment for a period not to exceed six months.
1919 (b-1) A person who has previously been appointed on a
2020 temporary basis as a county jailer and separated from that position
2121 may be subsequently appointed on a temporary basis as a county
2222 jailer under Subsection (b) at the same or a different county jail
2323 only if the person was in good standing at the time the person
2424 separated from the position.
2525 (b-2) A person who has cumulatively served as a county
2626 jailer on a temporary basis under Subsection (b) for two years may
2727 continue to serve for the remainder of that temporary appointment,
2828 not to exceed the first anniversary of the date of the most recent
2929 appointment. The person is not eligible for an extension of that
3030 appointment or for a subsequent appointment on a temporary basis as
3131 a county jailer under that subsection at the same or a different
3232 county jail until the first anniversary of the date the person
3333 separates from the temporary appointment during which the person
3434 reached two years of cumulative service.
3535 (b-3) A person whose county jailer license has become
3636 inactive may be appointed as a county jailer on a temporary basis
3737 under Subsection (b).
3838 SECTION 2. As soon as practicable after the effective date
3939 of this Act, the Texas Commission on Law Enforcement shall adopt the
4040 rules necessary to implement the changes in law made by this Act to
4141 Section 1701.310, Occupations Code.
4242 SECTION 3. This Act takes effect September 1, 2023.
