| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 318.021, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 318.021. APPROPRIATIONS TO HISTORICAL FOUNDATIONS: |
|---|
| 13 | 13 | | CERTAIN COUNTIES. The commissioners court of a county with a |
|---|
| 14 | 14 | | population of 175,000 [239,000] to 825,000 may appropriate money |
|---|
| 15 | 15 | | from the general fund of the county to a historical foundation or |
|---|
| 16 | 16 | | organization in the county for the purpose of purchasing, |
|---|
| 17 | 17 | | constructing, restoring, preserving, maintaining, or |
|---|
| 18 | 18 | | reconstructing historical landmarks, buildings, and furnishings |
|---|
| 19 | 19 | | that are of historical significance to the county. The foundation |
|---|
| 20 | 20 | | or organization must be incorporated under the law of this state as |
|---|
| 21 | 21 | | a nonprofit corporation. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
